Ref: This postWas searching for the information you wrote a while back on applying for "hard standing parking status for your drive" I think I've got a new neighbour on the way and he's been canvassing opinions of other neighbours about the number of cars stored on my drive.............. He first saw the house when I was at Le Mans and put in an offer that was accepted...... Driveway score at that time was 1 car............... Basically as I was in Le Mans with the Monza - Polo was in the spray shop getting sorted - Lotus was in the garage - Senator 1 was on the drive (covered) and Senator 2 was removed just prior to my trip..... Now they are all "outside" covered or otherwise as I've been doing some work in the garage - loft boarding etc so all the cars are driveway stored till I get it finished I mean for Farks sake he hasn't even moved in yet and he's already getting up my nose!!!

just have a word with him when he has moved in, or get to talk to your neighbours, people like this i try and ignore, but they usuall have such meaningless lives that they hassle people until you are backed into a corner, so i say be proactive and defend your rights and property vocally.

I say go and turn on the charm when he moves in, introduce yourself and welcome him to the street or something. His life is probably utterly empty apart from writing letters to 'Points of View' and he'll soon forget about the car thing when he realises you are not actually Michael Caroll after all, and can muster some basic courtesy towards him. What a toss pot, bet he reads the daily mail too.

I agree with Mr B - definately the easiest way forward Agreed but......... Alistair did point out a very interesting legal point a while back and as I have to make some changes out the front anyway I'd like to slip it in so to speak while he isn't moved in yet!!!

This is all based on *my understanding* of planning law.
Right a "driveway" is apparently defined as a vehicular right of way onto your property. The clue is in the name, you "drive" on it. "Hard standing" is somewhere you can stand a car. People who have been in trouble with the council have been done because they had cars parked long term on the drive. Planning concent for a driveway does not include the right to "store" a vehicle on it. You can be in breach of planning regs if you do so and someone wants to make a pedantic case against you. If its "vehicle hard standing" on your within your rights to stand vehicles on it, presumably for as long as you like.
What you can be done for on "hard standing" is causing a nuisance to the neighbours under this new "neighbourhoods" act. So half dismantled cars and the like can still get you in bother and could be towed off by the council after a prohibition notice or something similar is issued. Also I think theres something in some Waste Material Storage Directive which gives them the powers of balif to remove "scrap" from your property.
I deliberately labelled my existing drive as "vehcile standing" when I put in the planning for my garage. It was accepted so technically they have accepted a change of use from a drive to a standing area as part of the plans they approved. I doubt they even noticed as they were looking at the garage as the main thing on the application.
For all I know the drive could already have been down as hard standing, I dunno.
What I would have done otherwise if there was already a garage up would be to send in some small plan for a minor change - widening the drive, a low wall, that sort of thing. These always get passed as not needing a full application - but on the plan marking the existing drive as vehicle standing. When they pass it back saying approved you have hard standing not a drive.
As I say, any public nuisance or waste regulation stuff supercedes this as far as I understand it.
Also as far as I know running, driving, regularly used vehicles are less likely to cause trouble for you as they are using the drive to access the property. I once fell foul of the council for leaving a car parked inthe same spot inthe street for more than 28 days. A street is not for the storage of vehicles I was told - as it hadn't moved for 28 days it was "stored" not "parked".
In your case I think you are best just to try get on the good side on new neighbour. Does his property face or adjoin yours?

Also worth mentioning (as I was in a hurry last night) are Deeds of Covenant on a property. A lot of time now you have more to worry about with these than planning regs.
These are basically contractual obligations regarding your property (and if you rent they are usually passed on in the tenancy agreement). Even if your house is modern there can be covenants going back centuries. My parents place was built in 1972 but there are covenants going back to the time of the crusades as its Templar land, and he ended up having to track down the legal aires to the Knights Templar to get permission to put an extension on it...
Covenants often have odd things in them, one my old house probited me from opening a tannery on the premices or "conducting foul trades". The current house I'm not allowed to put an extension on or alter the external appearance of the house.
Whats more interesting is on modern builds, usualy those in estates or "developments" as they call them now you will find all kind of things relating to cars and parking. This is another reason I only look at old houses... A workmate at my last place got a new build and the deeds prohibit owning more than two cars, parking more than one car on the drive and no caravans. He is also banned from doing any work on a car on the drive or performing any work which takes more than one day to complete. Blimey. Old houses for me. I can live without my own tannery.
The last thing is to keep on the good side of your neighbours as they have to power to make your life hell. Even 10 years ago before the last slew of laws a chap who used to be a mate (long story) got a prohibition order on him through the environmental office of the local council due to his neighbour complaining about the cars. He wasn't allowed to use any power tools, nor any aerosol cans, nor to sand filler. If a neighbour wants to go down this route they will find environmental breaches. Its just the nature of life. Even a guy without a car, just the common garden shed is probably full of environmental breaches, so someone working on cars.... well... they'll need a second note pad.
Funnily enough I know people who do get away with murder, but its down to luck and your ability to intimidate people I think...
