I'll try and keep it short.
Sold the Saab last October, guy filled his own details into log book, I completed the rest and sent it to DVLNI (Driver and Vehicle Licensing Northern Ireland).
One week on, police at door at midnight wanting to know if I owned it. Stupidly I didn't keep a copy of his details, but satisfied them that I had sold it on, and they left.
Last month, got a letter saying i'd failed to pay a parking fine and would be summonsed if I didn't pay. Filled in the section explaining why I hadn't paid but have just got another letter saying that I am still the registered owner and am liable.
I can appeal to a tribunal but if they don't believe me, I end up paying even more.
Any legal experts out there?

Just keep telling them, maybe keep a rough diary too.
The same thing happened to me with my old 518i. Sold it, matey filed in the details and i sent it off, job done.
The 4 months later i get a bollocking in letter form as "my" car was involved in a RTC in central London at which the driver had fled. They attampted to take me to court but luckily i had a cast iron aliby in the form of my wife, my 2 day old baby and lot of hospital staff, but still, it as annoying.
The thing is, even in a day and age of technology and computerised everything they do still get it wrong.
Even if the worst should happen you've got nothing to worry about as they have to "prove beyond reasonable doubt" that you're at fault. And as you're not incontrol of the car anymore it should be easy enough.

There is no way that I would ever pay a fine or go to court that is nothing to do with me....what is more worrying is the fact that they get it wrong all the blodey time, and if they are getting simply things like ownership wrong, what else are they messing up?
I got a letter explaining that the tax for my SJ has not been paid and they have records to prove that it is still being used on UK roads. How the heck can they have records that it is being used on UK roads? The car was exported to Mongolia! Trying to convince the representaive on the phone that I do not have the car was quite difficult....and you know you are back to square one when you get told that the only way forward is to fill out a SORN notice ASAP!

assuming they are the same as dvla.... write a letter and send it special delivery. keep a copy for yourself with the proof of posting. all you need to say is that you sold the car on XXX date and are no longer the keeper, owner or in any way responsible. you honestly cant remember the details of the buyer, and would appreciate them updating their records accordingly to show you don't own the car. Once that is done, you need to contact the parking people who issued the fine. Send them basically the same letter, telling them you have sold the car on xxx date, it appears there has been a screwup somewhere and you are not the keeper or owner, and it certainly wasnt you who parked it illegally. tell them you have now notified dvlni and you would appreciate them dropping their file on you. Send this special delivery too and keep copies again in case things go further.
Worked fine for me.

The probelm with modern day "administration" is that it's simply a case of...
"Well, that's what the computers telling me"

Been through a similar thing recently with Aberdeen City Council, except they lost the notice to quit on the lockup we rented to store stuff in during our house move. They eventually found our new address and said we were owed xxxxx quid and that they'd send the bailiffs 'round to recover it. Took a few stiffly worded letters and dealing with "computer says blah blah blah" idiots before we finally got passed to the top of the food chain and the whole thing was dropped. We eventually got a letter saying no further action would be taken and they apologised for any distressed caused. Took long enough, mind. Hang on in there, and ask to speak to the organ grinder as soon as the monkey on the phone starts to curse word you off.

Just home from work.
Thanks for the replies and advice; I will phone the DVLNI later and write a letter to the tribunal for the appeal.
I am going to refuse to pay any fines as this is only the second time I have experience of selling a car privately and a similar thing happened last time - we sold a Mk2 Fiesta with XR2 running gear to a car breaker I've known for years. Car was too good to be scrapped but nobody who wanted to buy it could get insurance over here. Police were in touch several times about drive-offs from filling stations despite both us and the breaker sending the relevant paperwork away.

Imo you should be able to complete the sale details over the net like you can for example in new zealand. That way their computer is updated instantly and there's no messing. The minute this is done the car is no longer legally yours.
But then (like the uk banking system) this is just another example of us playing "catch-up" with the colonies.

yeah, was about to say the weak link in this is the postal system not the computer.
I've asked for the cover note for my car twice now and its still not arrived. Had to ask for my new PIN for my bank card twice before that arrived....

There is no way that I would ever pay a fine or go to court that is nothing to do with me.... If you get a court summons though the post, your going to court! Ive no doubt this will all be sorted out, although it could well be a drawn out process. Stand your ground!

got a letter from the dvlni about my 106, saying I owed about £200 in back tax and stuff.
my letter said pretty much " I sold it around 3 months ago, and I don't remember who to, or where he lived, but I did get the v5 filled in,and I sent it to you, so do your job right and leave me alone. it isn't mine any more and don't be expecting any money hi"
and that was the end of that.
just tell them where to go mate. they'll chance it if you give them an inch, as they really do word everything in scary-scary terms to frighten people into paying up...

If ther'e are locations listed on the tickets and they appear to be in a similar area,go around and get YOUR car back and sell it on,this time do the paper work properly and use the proceeds to pay your fine. You have to go to court any way. BUT remember one thing,you do not have to prove your innocence ,they have to prove your guilt.

I'm definitely not paying thses fines - they can chase me all they like.
At the bottom of the form, it says that if I go through the whole process and lose, I HAVE to pay or they will seize the vehicle. Well, that suits me just fine, because it isn't my bl00dy vehicle.

You wont have to go to court, I bet any court proceedings will be dropped at the last minute. They use the threat of court to lever you into paying up wether your guilty or not. If you do get any dodgy letters threatening court just send one back saying "fine, see you there" You are innocent, afterall!

I wrote off SWMBOs car a few years back (not my fault btw)...the car got 'scrapped' then 6 months later got a fine through from a brixton authority...one call and it was gone. Dvla just took our word and took our details off!

Had a similar thing happen to me with an old XR3i I scrapped it, the breakers yard issued a notice of disposal, signed the log book over to them and I forgot about it. Few month later got a sh!tty letter through saying I had not paid my road tax. Sent them a letter back with dates on and they sent me a letter saying (effectivly) that this time they would let me off! tbh I was a little curse word off concidering I had done all I needed to do.
Just remembe you are NOT at fault!

If you do have to go to court don't forget to claim all expenses and any loss of earnings. If your employer incurs any costs to cover you while at court make sure you claim those too. Make all this clear in any letter you send and explain in polite terms exactly how you are no longer the keeper of the car and that all costs will be born by them when the court finds in your favour. Always remain polite, an abusive letter can end up with you facing a criminal charge!

Thanks for all the words of encoragement guys.
I have decided not to get myself worked up about this. I'm just writing a letter every time a fine comes in, explaining the same thing every time. When I get the letters threatening court proceedings, I am sending these to the tribunal. The first one has come back saying they are now investigating the matter.
The DVLNI has told me by phone that they have had my details since November (then why the hell haven't they done anything about it!!!) and will be posting a letter of confirmation.
The tax is up on the car next month, and I will most likely get the renewal. I'm planning to not pay the road tax, then by the time it runs out, the DVLNI should have on record that I'm not the owner and hopefully the new owner will get caught without tax thinking I'm still footing his bills.

Similar thing happened to me with my Renault 9. It got towed away then a few months later I got a speeding fine through for it (80m mph in a National so he obviously got it working) I rang the Police who issued it and they got it sorted for me with the DVLA and everything. I didn't know who I had sold the car to but the police gave me a courtesy call to tell me they'd resolved the situation and had managed to contact him through his insurance details.
