Perhaps the cleo driver would come under a seperate case of dangerous driving? Without being funny, you've got to prove it. Dangerous driving needs to be either caught on camera, or witnessed by a policeman. Even in this latter scenario it'd be his word against the driver's. And as nobody even got the registration number, less so the identity of the driver of the clio, then you're stuffed Next time someone pulls out in front of me, I'm not going to swerve!! That is by far the best plan! Brake as hard as you can, but don't start thinking about other things to hit if someone has caused the accident, just smack into them. You'll get no congratulations if you hit a postbox / phone box / garden wall / parked car instead of the numpty who caused the accident, and if you miss him totally and he drives off, he's pretty much got away scot free. You've also gotta think, cars are designed to crumple. If you swerve out of the way into a lamppost, they won't crumple and you'll do a lot more damage to your car, possibly yourself too.

Apparently the police will proscute someone for dangerous driving on just one witness statement. If you ring up and say a saxo A123 ABC was driving dangerously and cut you up you can inform the police who will send a NIP out to the owner. You have to make a full statement though. Seems wide open to abuse though IMHO.

Doubtful. A lad on another forum I used got hit by a guy who'd been driving like a completye ass, when he got out of the car he was swaying and smelt of booze, got back in has car and drove off nearly knocking over pedestrians in the process. The lad got his number and a description of him. The cops said a prosecution was "not in the public interest" which generally means they thing that a court would throw it out. He spent soe time tryig to force them to prosecute but they just said nah-ah.
The fact that dangerous driving is so hard to prove in court is why we need a new offense of causing death by careless driving... careless driving is a lot easier to prove.
You may be able to get careless driving on a simple witness statement. But maybe not.

Bike camera was suggested recently, similarly car camera, but apart from being OTT(?) hassle, it can work against ya too, as it was for a speeding biker on police camera/road wars programme recently!

I know it won't sound too helpful here and now, but don't let rubbish like this get you down. I had my car smashed up by an uninsured cab driver and never saw a penny - even after taking him to court and winning...it bugged me for years and effected me far too much in too many ways. Letting that whole episode (including the car) go was one of the best decisions I ever made. Do what you can, but don't allow it to eat you. Keep doing the right thing, even if you appear to be the only one most of the time. Hopefully there'll be some Karma for all those selfish idiots we seem to meet all too often.

Commiserations Qwerty Not a pleasant situation but hope this doesn't put you off retro cars. Now then... I'm no copper but I think "failure to stop" is only an offense if you are in contact with any other vehicle or pedestrian. Not convinced. I know someone who was cautioned for failure to stop at the scene of an accident, and not only had they not come into contact with anyone / thing (ie the accident in question) but also genuinely not even realised that they'd caused one.

Sorry to hear about your 'incident', and I can understand how you feel.
But ust to prove how many fools are out there, Toptaff, me and Lily the terrier were between Junctions 46 and 47 of the M4 this afternoon (coming back from the Pencoed Show) in the Nippa when, oooof, right in the rearview mirror, and doing about a ton, was some burke in a clapped-out Fiesta.
Oh - did I mention he was on the hard shoulder, undertaking everybody???

With so many threads on R-R I somehow managed to miss this one. Really sorry to hear about your bad luck Qwerty. It sucks that an innocent guy can be left in the sh!t while the guilty party goes scot free.
Remember this though mate....and it's a lesson that I as a long term sufferer of depression still haven't learnt fully.
