dash curse word pee and gosh darnage! (have that swear filter!) So not only did I buy (and sell) a car that Keef will take the pi$$ out of me forever , but so it comes back to bite me on the ar$e too. Seems the fella I sould it to did me up the kipper with a false name and address. DVLA send me back the V5. AND THE FEDS SEND ME AN INTENTION TO PROSECUTE. As the V5 was rejected by DVLA, I still own it. And it got clocked on the 4th of December doing 68mph in a 30 zone in Burton-on-Trent (where I have never been). It's probably still rolling on bald tyres, buckled wheels held on by 3 studs each and rotten to the core. In short, it looks like I am gonna be kissing my license goodbye for a bit, seeing as I already have 6 pts on my license. The lad I sold it to has been booted of eBay too. All I have is a mobile phone number. The offending article: cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&item=220033505131FUKK A DUK. Advice / help would be nice retro peeps.

Damn, too tired for advice but i'm sure you'll get there with a good solicitor if need be. And this is why the 'system' don't work! It will be ok. I think

it doesn't matter if it's a Morris Marina or a Toyota Celica - it's what you do with it that counts

Holy curse word! Is that possible? Sorry, stupid question. I can't believe somebody gives you false details and you're held responsible? That grips my curse word. Really sorry to hear that, and I guess that's a warning to all of us. Cross reference to a photo ID on sale I guess?

Sh!t. Surely to God they can't prosecute you for anything?! I mean, anyone can give a false name to the DVLA.
Hope you get this sorted mate

How can it be OK? All I have is a name, a mobile number (which is still active... 'Hello can I speak to Mick...' 'Yeah hold on' 'Is that Mick?' 'No' etc...) and a print off of the eBay auction which don't prove sh1t. I do have evidence that proves I could not possibly have been driving at the time, as 'registered keeper' failure to say who was still makes me guilty.

Thats harsh. Really harsh. Is there any way that Ebay could find an address for you to go by?
[edit]
How about the day you were supposed to have commited the crime? I'm sure you can find someone who can verify where you were.

Ok, citizens advice bureau would be the best place to find out where you stand.

I'm sure you can find someone who can verify where you were. As the lad has been suspended they won't dish it out. FCKERS. I was actually at work in Putney at the time of the offence, as could be proven by our work log-books (booking on to work on the underground is a beaurocratic nightmare but has it's advantages),..... BUT I am required to tell them either (a) who was driving or (b) who I sold the car to. I can't do either. MUTHA FARKING traveller SCUMCUNTZ

Playing devils advocate, I guess this is to counteract you 'selling' a vehicle to a bogus character and then commiting crime with it and using that as your defence. Which is a ridiculous scenario, because you just steal and clone a vehicle if that's your intention. The fact that it still makes my curse word boil is undeniable though.
If you're going to lose your license, I'd be tempted to take it all the way. Use the forum thread/ebay as proof of sale, witnesses to it leaving the area (neighbours etc), alibi for time when being driven etc
But surely if you've produced a name which to the best of your knowledge is correct, you'd done nothing wrong? You were asked and supplied the details, no witholding of information or perversion of justice. You have been defrauded, thereby making you the victim? This society sucks the fat one, I'm so very sorry to hear this.
Contact the motoring press, picture of you with the ebay ad etc looking annoyed, something must be possible.

Just occured to me, this is relevant to anybody selling a car to anybody else. The motoring press no matter how blinkered on occasion must be interested... PM me if you need some words drafted.

Surely if you have sent of the registration document with the new keepers details then you have filled your part of the obligation. It's not your fault that the new keeper supplied false details. how could you possibly verify that information? I would print out copies of the auction just in case as it could be useful for proving that you sold the vehicle.
It might be worth contacting some of the other sellers who have sold mailable items to this person as they may be able to supply you with their address.

That is a good idea, Bryn.
Basically I knew from the outset this would be hookey.
I sold the car as essentially scrap. I gave explicit instructions that it MUST be removed by trailer and that it would all be done 'by the book'.
I even had the guy I rent the lock off open up the big security gates especially in readyness for a big lorry.
Instead this scar-faced illiterate turns up, 5 hours late with a 5-series BMW and a static bar to drag it the 100 miles home. Instant tw@t. The owner of my unit saw them leave and could also vouch for me, but I'm still not sure any of this would stand up against the 'system'.

Maybe some detective work might be required. Contact some of 'bigmickmarshall' ebay sellers, and see if someone might have a contact address. Not sure whether that will make any difference to the problem in hand, but could help level out some 'justice'.

This really makes my p!$s boil and it's not even me that it's happened to. Show the "authorities" such as they are this thread, I'd happily put my name forward in court that you're not a shister.

Well the address was a non-existant road in Burton on Trent, but the postcode actually corresponds to a scummy part of Derby...

So, is there anyone up near there that could possibly cruise past those addresses and look for signs of car stuff?
