i love this contry and its bull curse word laws here to incriminate and victimise anyone EXCEPT the criminals, they have no proof that it wasnt you...... so the simply assume it was you.
if he is ignoring you on the phone, get somone else to call him, say 'my mate said you might be flogging some escort parts, i need a bad boy bonnet etc etc can i come n have a look blah blah blah. might be worth a try? but its stil a pretty lame idea.
i realy don't know what to do, only that if they are taking your license then you should fight it alll the way as you have nothing to loose, and you are innocent after all.

If I'm right in the memory banks - but probably a load of ....... As long as you provide enough evidence to point them in the right direction - i.e. give them the user ID of the offender and then Ebay have to hand over the name to the rozzers as it's part of an ongoing criminal investigation......... so the work has to be done by them and E-gay have to pretend to be law abiding citizens of goodwill etc... Your proof you were not present means they can't prosecute...... Any evidence given to a letter summons ( read the avoid gatso type thing ) - it is without caution and most probably inadmissable - thus taking all the resulting investigation needed out of your court ( pardon the pun ). Should be more than enough to get them to back the fVck off....... Hope it works out......... ;D

I took the liberty of googling his ebay id and turns out he has bought a lot of stuff from t'bay.would it be possible to contact his other sellers and see if they have any info on him?
**edit** he's also bought stuff off ebay fr. and ebay de. someone MUST have an address for him,its just whether they will pass it on.

Yeah if he's bought from ebay.sausage and ebay.frog then it must have been posted to him, hence they must have an address.
You've got a good case I reckon. The police CAN'T do you for the driving offence, simple as - you've got proof it wasn't you. Like you say there's a chance they can do you for the failure to complete the V5 properly, but I'm sure that's a "knowingly failing to complete...." - how many times does a car seller request a buyer turns up with passport, driving licence and three character witnesses?
Basically pen a nice letter to the DVLA stating some facts, point out it's now clear that the address given by the new buyer is false and that you feel you've done as much as you're expected. Then do the same to the cops. Unfortunately it may turn into Pog Goes To Court but I doubt this will get settled in the 28 days you have to respond to a speeding notice. A magistrate may be the best thing for you, someone who will sit and listen to the case instead of just firing off computer-generated letters.
In the meantime, I say register his car as scrapped with the V5 and wait till he gets pulled in it. Should be interesting for him to explain that one.
EDIT: IDEA!!
Wait till he buys something next. As soon as the auction is over, ring him and say "Yeah hiya mate, is that xxxxxxx, you've just bought my xxxxxx on ebay but i deleted the email from eaby with your address. what was it again?" then go around and set fire to him.

I once sold a car to a guy, and when he came to pick it up I was out and he told my parents (it was a long time ago!) that they just give him the log book...
Well, a few weeks alter I start getting his parking fines...
Luckily I saw the car in town and followed it home, made a note of the address and passed it on.
I was threatened with a £1500 fine for failure to notify the DVLA but they backed off with a "don't do it again".
Not sure what the deal is now but there was no mention of points if that makes you feel any better.
eBay will have to give up his address if the cops get a court order for it, but is there any guarantee that he gave the right one to them?
This reminds me I never notofoed the DVLA of the sale of the Ventora as I've lost the V5 and was looking for it... to send of... Now I can't find it... An I think I've lost the guys' address now anyway (I'm hopeless)

fcuking hell mate!! i cant see how they can do much if you can prove where you were at the time. Remember that the dvla are wnakers, so it might be best to do everything by writing and keep copies etc. have you learnt your lesson about buying chav wagons when on ebay after a few jars? ;D

You've fulfilled your legal obligation, at least you didn't just hand the guy the V5 and trust him to fill it in himself.
You can't loose you license without this going to court and if it goes to court it wont take much to prove what has really happened, especially if you have witnesses willing to testify you sold the car and you were at work when it went through a speed camera.

Sounds like you have got plenty cover, theres ace suggestions in this thread. Ebay evindence, although weak, us (diary) and we know you would not tool around in that monstrosety etc etc. tell em straight in a letter. in the mean time yeah, pass on all you can to the dibble, phone number addresses (anything on his buyer email), or buy something off him. I will guarantee theres more dodgy stuff happening if the dibble (or us) investigate. Pi$$ boiling? yeah, like said you did your bit, what more do they want?

Sorry to read about this pog. Looking at the other items he's won, 3 / 4 of them are from Derby...so I would ditch looking for him in Burton-On-Trent He's not afraid of travelling to collect cars though - Nottingham, Essex, Manchester etc... The last item he won makes me giggle though curse word!

I have recently had a similar problem, and short of asking for photo Id a birth certificate and at least one parent accompanying I cant see a way of avoiding it.
A lad came in asking to buy an old (E30) 3 series I had sitting, money was paid, logbook filled in, bye bye car. Two days later he brought it back, saying he couldn't afford the insurance so I bought it back (what a nice guy I am, didn't give what he paid though). Logbook went back in the drawer, cos I hadn't posted it yet.
About a fortnight later, I got a Gatso ticket for 95 in a 60, from the time he had the car....DOH!! Dug out the logbook, went round to the address he'd filled in, road exists but number is a carpark between shops. So I rang the Issuing office for the ticket, explained the situation, they said to put it all in writing and thanks for telling them, that was the end of that! Apparantly, it happens a lot! they only push speeding tickets with evidence (or admission) of guilt cos they are expensive to prosecute properly.. Ist like burglars, without a doer, they can't be bothered.
The draconian court threats an fine letters are to scare people into coughing up without a fight, but I find if you challenge them (politely) 9 out of 10 you get somewhere.
A side note about the DVLA though...... If you don't post the logbook, or notify DVLA in a letter that you sold the car (if you hav'nt got a book) they will fine you £55 when soneone applys for a book. This too happened to me..... I couldn't find the book for a Magnum 1800, so I got a V62, filled it in with the buyer, paid the £19 fee (myself) and posted it. I then got fined because I (seller) had not sepapratly notified them of the transfer. So that one cost me £75 for a lost V5.
As for the Barrymobile....Write to DVLA, returning the logbook to them. You don't have the car, ergo you are not the vehicle's keeper (read the notes) Its not your fault the lowlife gave a false name, they will just have to put it on the No current Keeper list on the PNC and wait for someone to get pulled in it. don't pay the fine either. Its issued by a computer with no legal expertise, and given the circumstances wont get prosecuted. don't expect a refund if you do pay it though. Good luck, and hope this helps.

Don't worry, nobody can prosecute you for an offence you didn't commit. You don't need to track anyone down. Just write to the court and the DVLA and say when and how you sold the car.

I'm sure you'll get it sorted - one way or another.
We had a similar experience with our Saab 9000 - unfortunately not quite as severe. We sold the car at auction but this was before you were obliged to complete the logbook in situ - few weeks later parking tickets from London started turning up, so a letter was sent to the DVLA.
They acknowledged this fact, that it most likely didn't belong to us anymore - still, we recieved more tickets, then a speeding ticket.
A more strongly worded letter was forged and sent on - next week a letter arrived saying the car had been found parked illegally and ticketed, again and that they intended to cube it if we did not pay outstanding fines.
My dad just sent them a letter replying "Make it so". ;D

So basically, if you want to drive fast, pay for no Insurance tax or MOT, best thing to do is Illeagally 'buy' a cheap car off ebay and enjoy. nearly cheaper than a trackday, meanwhile we all risk getting our asses whooped for 45 in a 40 while looking at the road, or being mowed down buy an uninsured barrymobile! Sounds like a big hole there to me. can't think how they'd get around It though without painful red tape and fees!

BCA have changed recently so you HAVE to fill out the appropriate bits of the V5 and can't sell one without it - I can't remember much else about it tho, 'tis been a while since I've been down Enfield. Not sure about the smaller ones though

The landlord from my old local bought a car off a customer and kept winging about him filling in the V5 and sending it off. In the end the customer got fed up and sent it off with the new owners name as Mizerable Old Git Lambert. It went through the system no probs and later appeared in a story in the Sun.
