Was just on the M1 coming back from a show. A BMW spun out and hit the barrier at about 70 ish, totaly ruined his car. He avoided anyone else though luckily. What happened after i don't know, debris all over the road!
Thing is, i saw it all and i was the first car he swerved to avoid (he was behind me).
Bad because i feel guilty even though it wasnt my fault and i did nothing wrong.
So, call the police in case they need witnesses or forget the whole thing?

To be honest, I'd leave it unless there's an appeal for witnesses.
If he was insured and nobody was injured (and he didn't hit any other vehicles), then it's all covered.
If you phone the police, they'll either not be interested, or nick you for fleeing the scene of an accident!!

If the accident was caused by him swerving to avoid you then technically your vehicle was 'involved' and so technically you should have stopped to exchange details. But in these circs you cannot be sure he swerved to avoid you as he was behind you so I'd let sleeping dogs lie.

Yeah, i guess so.
Not even sure how it happened. I came past him so he must have been going slower, i slowed/braked a little (about 5mph drop in speed) as a car pulled out in front of me, then he was behind me flashing his lights and swerving, he then came PAST me sideways, overcorrected and lost it.
I don't understand how he came past me, he must have pulled out real close behind me whilst accecelerating just as i braked a little!!

If you phone the police, they'll either not be interested, or nick you for fleeing the scene of an accident!! Probably the prior. I saw someone get knocked off their bike by a Mitsubishi FTO on the north circular, the FTO ran off and sprinted across a junction with a red light to get away. I got his number plate and description, and I saw a copper about 300 yards up the road, stopped and told him and he said "theres nothing I can do about it now, just keep an eye out for Appeal boards next time you're in the area". Lazy c***.

Although the right thing to do probably would be to inform the police just incase they need information from you, personally I wouldnt incase you get dragged into the situation legally and end up being done for somehow causing the accident or leaving the scene of the accident without stopping or something.
Ive heard of much worse accidents that have happened and nobody has stopped at all- maybe in too much of a rush or scared they will take the blame somehow, or maybe people just don't care anymore. I wouldnt feel too guilty about it, if anything you should feel angry that the BMW driver nearly took you out!

You say he was flashing you?
Did he pull out behind you to try and overtake and thats why he was flashing you?

Well, I wasn't there so I can't really judge, but from your description it sounds like he was driving like a tit. I wouldn't bother with the police either. Like has been said you might get dragged into some sort of legal battle if he insists it wasn't his fault. If a car crashes due to the actions of a car in front, it's very rarely the driver in front's fault - he should have left enough space for him to avoid any incidents whatever the traffic ahead is doing. That's what stopping distances are for, and why they are so big.

I have no idea why he was flashing me! I assume it was to get my attention cos he was about to go in the back of me, maybe to see if i could move?
I dunno, as soon as i saw him flashing he swerved to the left.
It was an odd situation.
I was in the middle lane, not much traffic about. I came past him, a way in front of him was a metro (i think).
About this time there was a long filter lane about to join the motorway.
Once i was past the BMW the metro pulled into the middle lane, rather hastily, to let people merge. There was still plenty of road before the other road actually joined. I slowed a little and braked every so slightly. I assume the BMW also pulled in behind me to let people on.
He must have pulled in super close to me and as i braked realised he was going too fast, flashed me, then swerved back into the left hand lane.
There were cars in that lane by now so he swerved left again into the filter lane (there was still ages untill the filter lane actually merged). By this time he was actually going FASTER than me!
By this time he was also sliding, over corrected, spun and hit the barrier nose first.
I have no idea where he gained the extra speed, i came past him, he pulled out behind me then came past me sideways! As i said, i only slowed about 5mph when the metro pulled out.
I really cant work out what the f**k he was doing!!

Sounds like he wanted to pull in behind you, waited for you to pass, looked over this shoulder to see there was nobody there so he could move over, he changed lanes and by the time he looked back you had slowed down. He panic'd, swerved to avoid you and lost control..... I think.

Sounds like a tit to me!!!
General rule of thumb....using the footbrake will slow a car down quicker then flashing the lights!!!
It totally sound like it was down to his bad driving skills and it was just unfortunate that you were in front of him!
I wouldn't worry about it and just put it down to experience.
I had an experience a couple of years back when I was driving along the A483 in North Wales.
I was tanking along the outside lane and went past a (rather attractive) girl in a Nissan Micra.... as I overtook I noticed that she was using her mobile phone just after I passed her she had a blow out (I think) swerved across the carriageway hit the central reservation flipped over and rolled down the road spewing bits of car everywhere.
It brought the road behind it to a standstill and I just carried on going as there would hev been plenty of people to help out!
I presume that the tyre blew and as she had only one hand on the wheel, it probably yanked to one side and sent her out of control!!!

He panic'd, swerved to avoid you and lost control..... I think. That's a sucky situation for him. The ammount of times that's happened to me, look over your shoulder (as the curse word highway code states) and as you look back the cars in front are going a lot slower than you thinkg. One thing i like about swedish cars - they have anti-blind spot mirrors so you don't have to check over your shoulder.

I'd leave it. Sounds like he was either driving like a n0b, or completely at fault. Either way there's a risk he'll try to blame you in some way to save on his NCB..... if you weren't at fault and made a clean escape, then leave it as such in my book.

It all sounds a bit bizarre to be honest but the roads are full of complete and utter mammory glands these days...and not the perky varieties they we all cherish...
My GF (who lives in Florida) got involved in an incident a couple of months back when she made a left turn - some knob-head 4 cars back plowed into the 3rd car behind her and screamed abuse at her for causing an accident lol.
The police arrived and said it wasn't her fault but cars 3 & 4 were both blaming her for causing an accident...deary me.
