Sorry if this has been covered but I'm sure the answer is simple and it's something I've just come up against. With the new tax law meaning you can't transfer tax to the new owner, if you buy a car privately, ebay say, how do you get to drive it home? Legally please!

buy it then get online and insure it and tax it , get you pants pulled down and pay tax from the 1st of the month regardless of the date
if its localish i would be asking if the owner would consider delivering it and me giving them a lift home assuming they're still legal to drive it

Won't the tax still be valid until the previous owner processes the docs, so at least it won't trigger ANPR checks. I'm sure I read that there was a grace period.

If the original owner has it taxed, then personally, I would drive it home (providing other documentation is in order), as the vehicle is still taxed, whether you've taxed it or not. Then use the V5C/2 to tax it when you get home

Tax is refunded for current owner from 1st of the next month , when you tax it online , it starts from the 1st also , or so it seemed when I bought a car a few months back.

I drove home recently on a new purchase with old owners tax, it doesnt get taken of until its at the dvla office/ been posted(so at least a week or so). But of a black area but as long as its insured and mot'd i got home fine and taxed it the next day or week online(bad i know but was on my private drive for that time)

Being that it is still taxed until the v5 is processed I'd drive the car.
Surely if you're picking the car up, then you gotta sign the v5, therefore it isn't going to be sent off until that... Sooo this vehicle is still taxed.
When I bought my bmw, despite me receiving the v5 in my name, it wouldn't allow me to tax it online and I had to go to the postoffice still. Seems the system has some way to go before its as fluid as they make it out to be.

Recently swapped cars , both taxed so was able to drive home on my insurance as i can drive any car not owned by me and at that moment i was not registered keeper
But as i did the swap in a layby of a cafe at night the police spotted me and stopped me minutes after taking ownership of new car
explained the swap , eligibility to drive it and they said < i was well clued up on the law but it was a grey area > but their take on it to safeguard all parties is to have insurance applicable in place for new vehicle before driving it home but had to admit on the tax side of it a grey area they had not considered before

Ask three different law enforcement officers on the rules and you'll get three different answers. Ask the DVLA and chances are you'll get a different one again, how the average motorist is supposed to know what to do is beyond me because even enthusiasts are struggling with this one.
However, from what I've learned from the authorities, the internet and the DVLA website you are okay to drive a car home on the old owner's tax providing it has insurance and an MoT (unless driving to a pre-booked MoT... let's not go into that right now). If you can't tax at your own expense at the point of purchase - there may be no phone signal or internet access, you may not have a mobile phone - then do it as soon as you can at home or the nearest PO but keep the car off the road if you can just in case until you know it's sorted.
Short version: you can drive home on the previous owner's tax before the V5 is processed providing the car has valid insurance and a current MoT. Don't take the proverbial with it.

Thanks for the replies. It was a general question but in this specific instance I'm looking to buy a car for a project and strip it down once I get it home so it's gonna work out expensive to take out another insurance policy, even just a days cover, tax it for a month at least and get the train to the sellers house and the fuel home. Put all that lot together and it may well be cheaper to get Shiply to pick it up?  |

Some good answers here. a very grey area indeed. Interesting to see the police are still a bit vague on it. Having recently collected a untaxed car. Made sure insurance and mot was ok. Then taxed it in my iPhone using the new owners slip . I throught once you sign the v5 it's like signing a contract so it's now your car and thus meaning you have to retax it as your now the owner ?

I think people are over-complicating this because of fear that they're doing something wrong.
Before the new tax system was implemented- If the car you bought had tax you could use it, either until it had ran out or the owner had reclaimed it.
Now- The only difference regarding getting it home is that you won't be able to carry on using the tax once the DVLA have RECEIVED the information of changed ownership/tax transfer from previous owner.
That means provided the car still has tax on when you purchased it (i.e the owner hasn't already cancelled it and sent off documents), you can still drive it back as it will still officially be taxed on their system.
The previous owner is going to need to send documents off, this will give you at least 2-3 days leeway to sort the tax out your end and will be completely legal as the car will still be registered with tax until the DVLA have removed it on their/the police's ANPR system.

According to the DVLA site, it says "you will need to get new vehicle tax BEFORE you can use the vehicle".
So I reckon it depends how they define 'use'. If it means any use from the moment of becoming the new owner, then you cannot legally drive it home. As whitey pointed out, once you have signed the V5 the vehicle is now yours!
Of course, the DVLA computer will not have been updated so you are safe from getting caught by ANPR. But if pulled by the police you will have to rely on that officer's interpretation of the regulations.
It does seem that every change to the rules regarding car ownership and use over the last few years makes it harder to buy and sell privately. It is almost as though they were doing it deliberately.....

Have to say when pulled over it was nothing to do with the car i just swapped / they never done a check on it nor me just looked at my licence and listened as i explained the way i saw it legal to drive home with both agreeing to each other its to close a call to make a roadside decision as yes its taxed albeit to previous owner but too early for dvla to be aware and yes I'm allowed to drive any car with owners permission which although signed paperwork again not dvla aware and still technically owned by last owner.
And why was i stopped ?
Wearing a torch on an head strap so i could see to sign the paperwork that this thread is about.

Acting suspiciously by police logic in a dark lay by which i was only at cos my sat nav gave up the will to live and didnt know my way to owners house. Sods law but just goes to show whos about at 18.30 pm on a cold monday night near Brighton on the A23.

If you wish to be straight laced this is what you do. Basically you have to tax the car. This can be done by either the green slip at a Post Office or using the New Keeper Reference number on the V5 when you tax the car online (via the DVLA's site; it gives you the choice of taxing it as the old owner or new). Of course if you were willing to twist the rules a little you could sign the logbook off a little later and have the car insured. But the paragraph above is about the only legal way to tax a car . |

Legit question... can you tax a car which is already taxed? If so, on what grounds can the DVLA have the same car taxed by 2 individuals at the same time?
