what would you do?
You find a car on ebay, put a £400 deposit on it without seeing it..
The seller says he needs to remove engine (bought car without) and he said he needs it gone quick..
Left deposit on wednesday, was told I can have car at weekend. Borrowed a trailer but engine was still in car so I could not collect. A bit worried it may be a scam, I went to see the car and the seller was telling me the car maybe more valuable than he thought (yeh, I know thats why I bought it) so imo he should refund deposit until he makes his F****** mind up or do the deal. I would normaly just turn up with the trailer but I cant as the engine is not mine and is in the car.
I honestly think he is holding my money as a reserve deal and is waiting for a better offer.
maybe turn up with tools and mates, remove engine and take car?

It won't be at all helpful of me to say 'don't give away your money to a stranger on trust' because you've already done it. However, it might be helpful to say that this... maybe turn up with tools and mates, remove engine and take car? ...is something you should tread carefully with. If you contact him and say 'I'm happy to turn up with some mates to help you remove the engine so I can take my car away', that may go down pretty well. If you turn up on his doorstep looking angry with a load of muscle behind you, he may call the feds.

Ask for £400 back and cut it loose. Could turn out fine, but sounds like the start of what could be a lot of messing around.
Of course, by asking for your deposit back it might also get his backside into gear if he's up for a genuine sale.

I take your point, but i feel if i give him the oppertunity to say no he will, i think the last thing he wants is the engine out tbh, as thats all that is stopping me take it. I got the impression when i veiwed the car that if someone offers more then he will go for it. Deposit= i can't buy anything else, but he can sell to someone else.

Well legally the deal is done via eBay is it not? You can pull out of the deal if it isn't as described but he still has to sell it to you. Did the eBay mention non refundable deposit required? If you had paid for it in full via PayPal, I would just lift the whole car! Could threaten legal action too speed him up. Or a baseball bat! î•

Deal outside ebay, deposit via paypal. He did ask for £400, £2600 to pay...
Another point, and the reason I went to see it.
In the ad it states leather interior, and in the pic you can make out a leather seat side. when I veiwed the car 3 days later it had 2 manky cloth seats not bolted in. what do you think happend there then? I said it had leather in description and pic and he denied it saying he was refering to the rear and door cards!!??

Hmm I was going to say something similar to Bizzle, ie.
But on the strength of the leather interior debacle I'd cancel the lot. It's clearly not gone for what he wanted and he's started stripping bits off. I imagine a replacement interior would cost a lot too. If it was in the ad then I'd argue you're entitled to it. Sounds like a joker, I'd leave him to it.
Out of interest, do you stand to make A LOT of money on it? If yes, is it really enough to warrant dealing with this guy and his antics?

Gav, Just claim the deposit back through PayPal based on misdescription. Please, just walk away from the thing. If he's listed it as leather seats and you arrive to find cloth...and he tries to fob you off with some BS excuse, then what else is going to go missing before you actually get your hands on the car? If he's removing the engine, are you going to find most of the loom, the ECU, power steering pump etc...all missing too? What about the exhaust? (I could keep going but you get the idea!) Then factor in the whole delaying tactic where he's got your money and holding you to ransom over it? Where is this going to end? From what you've said, this guy is not to be trusted in the slightest. Get onto PayPal ASAP and get your money back. Oh, and Sully....baseball bats? WTF? As above, PayPal : Seller won't release the goods AND substantially different to description. The longer he has it, the less likely you're going to get what you paid for (missing leather, maybe missing bits and pieces).
Are we allowed to ask what the car is? Maybe spare another member the hassle of dealing with the bloke if you back out and he relists it?

To me, it skinks of someone hedging thier bets hoping for a better offer.
The fact that expensive to replace parts have been removed meaning that the item is no longer as described in the ebay advert would have me claiming my monies back though Paypal and washing my hands of the whole situation.
Life too short for dealing with money grabbing swindlers and theres PLENTY of other equally interesting motors out there, especially at this time of year, as you've noticed.

Thanks guys, i could not see straight on this as its heart over head.. I have been after a 911 project for years and this fitted. 3K for a rusty car with no engine/gearbox or wheels seemed fair.. !! I trade classic cars and usually would have run by now but i realy needed this, but as you can see this guy is effort. Its not a money spinner just somthing i wanted. I have sent a message to say if i can't have it tomorow i would like to be refunded.

Did you pay through PayPal 'normal' or as a 'gift'?
If the former, just open a dispute and get the money back, he's taking the **** now. He can't hold your deposit like that if he's the one who keeps changing the goal posts.

If he carries on refusing to give your deposit back, have you got a copy of the ad that said leather interior? if so then you've got all you need right there for a "not as descbribed" case, even if not through ebay, any goods, even private sales from the back of a telephone box ;D have to be as described. no leather + not as described, seller cant refuse a refund
