I'm having a bit of bother with the DVLA. I received a letter today from a debt collection agency demanding £80 for an untaxed car I sold to a guy in Ireland over 4 years ago. Now, I don't have any paperwork for this car due to the time which has passed, no details for the guy who bought it...
What can I do??

But surely if its a credit agency it will affect my credit rating? I'm looking to move house next year, don't want any problems getting another mortgage...

Never ignore any letter from a debt collectors or anyone who threatens that as next move. If it comes to court the court will want to know what action you took to explain you didn't owe the money.
I've been through this with a loan which was defaulted but I never took it out!
You should write to DVLA and CC the debt collector saying you sold the car abroad, you posted all docs to DVLA as per the instructions on the V5 at that time. Job done.
Its unlikely to come to court but simply stating your case in writing to them will help no end if it does.

My brother had this trouble he got a letter saying he owed £180 in total for not telling dvla he sold his car which he did,He phoned them up and said he posted the v5 off they said prove it.He went to see a solicitor who said it was his word against theirs.He went to court and the judge throw it out.But guess what 5 weeks later he gets a fine again for the same v5.

Heres a wee letter for the debt agency.
Further to your letter dated 10 February 2012 I am no longer the registered keeper of the above vehicle . I sold the vehicle over 5 years ago. At which point the relevant section of the V5 registration document was filled out and posted as required by the Road Vehicles (Registration & Licensing) Regulations 2002. You can therefore consider the legal obligation to inform the DVLA of a change of registered keeper fulfilled. As a result of your ‘claim’ which I am of course in dispute of then I do not see that it is legal for you to be ‘hounding’ me for such monies. I deny any debt and will under no circumstances make any payment in the absence of a court judgement. Please issue immediate proceedings in order that the matter can be settled. I will not contact you again. You will of course be aware that there is no legal obligation on me to prove that the DVLA have received this document and I expect no further correspondence from yourselves on this matter.

car I sold to a guy over 4 years ago. Did you post the V5 off with the new keeper's details, letting the DVLA know you have sold the car? I had a couple of these recently for cars i hadn't informed DVLA i had scrapped. I considered saying i had sent the docs off and seeing what they do, but at the end of the day i didn't fancy going in front of a judge and lying. So i paid. If i had actually sent the docs i would have been happy to go to court

There is a bit of law regarding dealings via the post: you do not need to prove that you posted it and your responsibility finishes when you posted it. They have to prove that you didn't post it which, clearly, they can't.
This is the flaw in all DVLA fines but not well publicised. The legal stuff will be on Pepipoo.

Yup, definitely sent the docs off. I hate dealing with the DVLA so i make sure I dot the i's and cross the t's...
Ive made up a letter for the DVLA to chew on aswell,
I am making contact with regards to harassment by a Debt Collecting Agency, Inter-Credit International demanding immediate payment claiming that I owe £80. With regards to this claim I dispute due to the following:
The car in question was sold over 5 years ago.I correctly filled in the V5 and returned it to the DVLA, fulfilling my legal obligation under the Road Vehicles (Registration and Licensing) Regulations 2002 & Interpretations Act.
I deny any debt and will under no circumstances make any payment in the absence of a court judgement. Please issue immediate proceedings in order that the matter can be settled. I will not contact you again.

Have you ever recived tax reminders for the car? i had a similar problem with the DVLA and a private car park company. Inform the DVLA of what you did with the car give as much info as you can and copy in the debt recovery firm, hopefully the DVLA will send you a letter stating they have updated there records and that you did not own the car at the time if so send copys to who ever is chasing you and i think you will find they will give up!

Nope, never had a reminder for it. Ive just checked the DVLA website and it was last taxed in june 2010...
I'm hoping the DVLA will leave me alone, but then lifes never that simple is it?!

Whenever i send anything to the DVLA i always get proof of posting it costs nothing at the post office and its great to send a copy to the DVLA and the debt collectors and tell them to do one. The grovelling sorry letter you get back is priceless.

Ok I have V5C log books dating back to 2005. It quite clearly says on the back of the 2005 V5C:-
"On receipt of a notification of keeper disposal DVLA will issue a acknowledgment letter confirming that the keeper has discharged liability." It goes on to say quite clearly... " If you have not received a letter after 4 weeks please contact DVLA"
Seems pretty simple to me. I myself have only not received one once. Phoned them up, then a letter was re issued. People are still being taken to court for it despite what you like to believe or read. I keep all paperwork relating to sale/scrapping of cars for several years simply as you never know.

if the website says the car was last taxed in 2010 and you sold it four years ago 2008?? sureley that means that the new owner was the last person to tax it so the dooovla should know who that was and where they sent the reminders etc?? or is it all different in ireland?

Used to get these all the time,don't ignore but just send the letter to both the Dvla and debt agency and you'll hear no more about it,always say you sent the logbook off even if you didnt there's no way of proving it either way.
In the end I had three for three cars I knew I'd sent logbooks off for,turned out it was the post office at fault. Each one of the cars required taxing as one was a p/x I was using,the other a car I sold,but needed taxing and the third was a second p/x I took in against it and sold immediately offering to tax it for the lucky winner.
Turned out the post office never sent any of the logbooks off,I had all the reciepts for taxing so proved that I was there at the dates and that it was their fault.
Dvla are useless,play them at their own game.
