Right, the scamming w@nkers of the insurance industry are up to their old tricks again and I was hoping to get some advice... Me and my brother get through a lot of cars, so we took out a traders policy. When I got the quote, I told them that I had 0 NCB because of an accident (the Merc). The guy then asked me how much NCB I had before that and I said (thinking it didn't much matter as I had lost it) that I thought it was 3 years. He then said he could magically give me a 1 years NCB for this policy (like that makes sense!). When the form was mailed to me it also didn't have my speeding conviction on there, so I wrote it in and sent it off. My brother has had 3 points but said this had expired. Soooo, when I got a letter this morning, it said that I had lied about my NCB before the accident (I didn't, I said I thought it was 3 years but wasn't sure), they also said that I had lied about mine and my brothers' licence being clean - I told them about my points, and genuinely thought my brothers had expired (apparently it's 4 years and not 3 before they're wiped...) - and they want an extra £400 for the cover. If I was to cancel, they said we would owe them 25% of the policy My question is: If I were to cancel the Direct Debit, would they have any grounds to chase me on this? I had agreed to a policy at one price, and now it's so much more money I don't want it! I know I'll lose the deposit I paid but I'm not shelling out any more money to the thieving scum

Read the small print in the policy - there's probably something that covers this situation..... Could you contact trading stardards about this?

Do you have a record of who you originally spoke to? If you do, and they do then you can win this. If the guy gave you the policy (with NCB etc) on the if, buts and maybe's of your previous history rather than definates, then you've been mis-sold.... I think.

You're allowed to reject the policy within 2 weeks of opening it - it should all be there in the small print. They're clearly lying through their teeth and its your duty to report them to the association of british insurers. www.abi.org.uk/Best of luck!

get in touch, make it clear you're putting in a formal complaint against the chap you spoke to for entering misleading information. If it was so important, he shouldn't have put you down for any NCB if you said you thought it was 3 years. Also request that they fax you a copy of the form you returned - not the copy they sent you, the one you signed and sent back, as this will have the speeding fine you entered on it. if they don't have this to hand they haven't got any proof you didn't declare it.
same with the phone call - do they "record calls for training purposes"? if so they might have your call on tape - ask for it. you're legally entitled to a copy for a 'reasonable fee'.
Also put in there that you will be taking it to the insurance ombusdman if you fail to be satisfied. These only get involved if the insurers own complaints system can't resolve the issue, but the insurer gets charged many thousands of pounds if they do come into play - so most companies quietly back down.
just out of interest, who is your trader policy with and how much does it cost? not that i want to get involved with this particular firm but when my fasty is back on the road, it might be cheaper for me to have a trader policy (rocco £200, fasty probably same, mondeo £500, plus whatever ebay junk i happen across).

With regards to 'trader' policies I thought you had to be/prove you were in 'the trade'. Also I hear that they only pay out 'action price' with regards to value of your own motor vehicle you happen to be in.
Also, any recomendations for who to insure with as regards to a modified car I have (not a retro), at present I have it insurred with elephant (and so far pleased with premium) and only charged me £7 for mods/alterations. As due for renewal next month Another car I have is due in september but is on agreed value (due to age) and is not modified, that is insurred with NIG. Just wondered?

Thanks for the advice! I shall be employing it soon. I spoke to a friend who is well versed in contract law. He says that, as this is a new contract (i.e.: not the original price that I had agreed to) I should have a further 14 days "cooling off" period, as the old one had expired. Also, the deposit was paid with credit card. They offer (as most do) protection schemes for just such disputes. So I'm gonna get the card company to fight my corner for me too. I've cancelled the policy and asked for a pro-rata refund at the original agreed rate.

Regards to getting a traders policy, if you can prove you buy and sell more than X number of cars per year, you are a trader. But this also has some bad things. None of the cars you have insured can be on HP (cos you obviously cant just sell it). Any adverts to sell your car in things like Autotrader have to be classed as Trade. Plus the tax man may look in to things. My cousin used to have a traders policy with his mate and looked into it. Shop around and you really can find a suitable policy for whatever you want. By this I mean not just going to the insurers listed in Yellow Pages, Max W*nker etc.
Remember Google and Yahoo search engines are your friends.....

I've noticed alot of insurance companies won't touch modified cars and 'modified' in their eyes can even mean little things like aftermarket Alloy wheels and spotlights
