Hi, i am not really active on this forum (or any to be honest) but ive got a slight situation that i would like some advice with, related to selling an old car that i had.
hoping some more experienced and smart people might be able to give me a bit of advice;
So, i listed my 2004 range rover td6 for sale around 10 days ago; reason being, my old man has just recently passed, meaning i have to find a new place to live, meaning i can only really keep my work truck. so it was somewhat of a quick sale, and i didnt particularly want to get rid of it, as has been so reliable.
once listed on ebay i had an offer from someone (despite literally writing in the description i will only entertain/consider offers in person) but people being people send offers online none stop, great. but considering this guy was first to message me after the "what's the lowest?" was out of the way, i said I'm sure we can get close to your offer price, but i wont entertain the idea unless he's in front of me, and has viewed the car, and is happy. (honestly i just don't feel comfortable considering offers when someone has not even seen the car in person)
with this being said; he told me he couldnt get over until the weekend and so, trying to be as genuine as possible, i made a compromise, i said keep your deposit, and i wont let anyone view the car before him (bare in mind it was almost a full week before he could get down here) (now, this car gained a lot of attention, i believe i priced it pretty low, due to the fact i needed to shift it this month, and i'd kept it in good condition for the short time i'd owned it) the car had around 70 watchers when my advert ended and i'd had 3 people offer to come and basically make a deal (i told them all the same, 1) i don't take offers online 2) i promised the first guy, first refusal, i thought it was only fair to stick to my word and he seemed genuine)
saturday rolls around and he tells me he can't get down there, but he will send his friend (who is jointly buying the car with him anyway) and he can view/make a deal with him over the phone, a bit annoyed, i agreed. he viewd the car, drove it, liked it, and via phone after his friends' inspection / advice we agreed on 2100£ (which honestly i feel / felt was too low, but i needed it gone, and so we agreed. he said he would come sunday morning for payment and collection, all good. sunday morniing comes he's over an hour late, fair enough, traffic, but annoyingly when we come to payment, he says "how about 2050£? i have to pay for diesel too" which was my first red flag, again, given that i hate selling cars/dealing with people, and needing it gone, i said, no, 2080 that's it nothing better. we paid and he left, all was done.
wednesday evening comes, and he called me "I'm broken down on scottish border (I'm from tamworth where he purchased the car also) and the gearbox has failed"
now- to point out at this point i was almost certain it could not be the gearbox, this car is old., but low mileage, genuine mileage of 115k, and i even serviced the gearbox myself when i got the car (despite that it was shifting fine, i know it's a weak point, and wanted to just be sure and keep it good) so iit was a full service, new filter, oil and seal. i even purchased a fairly expensive laser temp sensor to fill it accurately
i said i highly doubt that the gearbox has failed, and I'm about 4-5 hours away so i can't really do much, i offered to call around and ask, but i don't know what i can really do.
I spoke to a couple of land rover specialiists who advised it sounds like a drive shaft may have eaten the splines, and it just spinning, as this would cause the noise he suggested; and remove any drive. I did message it to him, but didnt get any reply.
I will admit, at this point i did block his number, i know it's quite childish, but i was getting quite stressed and didnt really know how to handle the situation, i take heart medication for stress / anxiety and some heart problems related to that, so combined with just losing my old man, and being forced to find a new home, and having to sell my car, and having my only other vehicle (my work truck also break down 2 days prior) save to say i was feeling it quite a lot.
so i woke up today to ebay messages saying; "AA recovery have come and are taking me home, they said you must have known about this problem (i had put a new MOT on this car, and it still had ~11 months left on it - it only had 2 adnivosires too - one for a rear wheel bearing, and 2 for pitted brake discs, nothing about any drive axle damage) you paid extra for a dodgy MOT i am going to report the MOT centre you used, and i am reporting you to ebay, i want a full refund or you to pay for repairsd which will cost between 600-800 £"
now, at this point i do somewhat feel for the guy, he has not owned the car long, and it has broken down, but i genuinely told him all (even the minor issues i ever had with the car, ive only owned it just over one year, and honestly, coming from volvo ownership, hearing all the stories about unreliable land rover stuf - i had been pleasantly surprised) So with messaging back and forth a bit, it turns out he was towing 3500 kg car trailers up and down the country. now sure, i know this car can/should be able to do that, but he got probably one of the cheapest end of the market land rovers of this model/specification, and instantly put it into towing heavy trailers. i actually fitted a new tow bar to the car myself, but had only ever used it for my bike rack.
currently; I'm waiting to hear back what his mechanic says about the car; now, i think I'm pretty sure i am not liable legally for anything at this point. but honestly i do feel a bit guilty, and i want to remedy the situation so that everyone's happy, but I'm still not exactly sure what to do, he already got the car very cheap (i feel anyway, i guess it's personal opinion) and i don't really feel like taking back a car that's hhad god knows what done to it, and is also now broken, plus it would be +2 owners on it.
but on the other hand i don't feel like it's fair that i foot a 600-800£ bill either. ive asked a few friends and relatives what they think, and most people say i just just cut any communications with the guy and be done with ii. i do feel like it's a bit unfair on him, i'd be upset too if i purchased a car and after a week or so it broke down on me.
