Hi, I am trying to understand the rules of the Certificate of Destruction and wondered if anyone who runs or works in a breakers yard can set me straight on my understanding of the rules?
If you take your car to a licensed ATF and ask that the car is scrapped, then if the car is de-polluted etc. then the car is crushed, cubed, cutup etc. and paperwork all completed properly, then
1.) by law a CoD must be issued to the last owner of the car, (not to be confused with last registered keeper.)
2.) Failing to arrange the CoD can land the ATF in trouble if an audit shows up one was not carried out. Penalties severe enough to make it not worthwhile for ATF to not bother doing paperwork?
3.) BUT if you just sell your car to a scrap yard, for breaking up and don't request it is crushed, totally destroyed etc. Then a CoD is not required even if the car is a cat B breaker?
4.) Once the car is down to the bare bones of being stripped out and only bare shell left, once disposing of the shell / remains, does the yard still need a CoD to finnish things off or does the fact is was stripped rather than crushed / scrapped fully mean it never needs a CoD at any point?
Anyone who knows the rules and is happy to explain to me that would be great as there seems to be conflicting info online and I am not sure I have got it right.
