Hello
I received a rather ominous envelope through the door this morning from a company called Parking Eye giving me a parking charge notice of £100, reduced to £60 if I pay within 14 Days.
On the 7th July I waited for a chap to appear who had purchased some wheels off me in a Holiday Inn Car Park operated by the above company. At the time the Hotel was not open to people staying only employees I found out this morning so should not be using the Car Park!!!
Anyone dealt with these guys before, various comments on the World Wide Web suggest this is a invoice and not enforceable, however they could take me to civil court to make me pay if I do not. It’s not the money, it’s the principal, I was in the CP for 15 minutes.
Thoughts?

similar but different. I got a fine through the post that the previous owner has caused by not paying a road toll charge.
I sent details of when the car changed hands to the council who own the road. Got another letter saying I was now at stage 2 or something. Get in touch and they couldn't find the info I'd sent them.
I just paid the £60 and got rid of the problem. Didn't enjoy it though.

You have to pay them now, can't remember which court case it was but the old "can't be enforced on private land/only councils can dish out fines" thing doesn't work.

You should be able to get off that one on the basis most of the cases they win are on the ‘breach of contract’ terms they issue their ‘fines’ on.
As you never bought a ticket from them that you overstayed, you didn’t enter into a contract with them.
Depends how far you want to take it really though.

If the hotel was/ is closed I would speak to them first as they have the ability to get it squashed. Hit them up on Twitter/ Facebook

I recently fought and won against these sacks of excrement. I would fight it on principle, they bank on frightening you into paying, including bribes in the form of discounts if you pay early. For an alleged 15 minute stop in a car park I would definitely fight it, you have grounds to appeal on grace period alone - by their own code of practice they must allow at least 10 minutes upon entry to the car park in order for someone to read, understand the signs and decide whether to stay or leave. And they must allow at least 10 minutes grace period in order to leave the car park. You are well within that time. forums.pepipoo.com/ is a great source of information for fighting these scumbags. www.moneysavingexpert.com also has a decent section on fighting parking companies. No doubt you'll find many cases similar to yours, with advice on what to do and how to fight it. Read through the advice very carefully before going through any appeal or contacting the parking company in any way. Mine was for an alleged overstay of a few minutes in a free car park. I first appealed to the shop it was adjacent to but they said that they had no influence over the parking firm. I gathered my evidence and went through their internal appeals procedure (you have to do this as the first step). They rejected my appeal. They pretty much always do, and then they gave me another chance to pay the "discounted" amount as a "gesture of good will". This was to scare me into blinking first but I took mine to the next level which is an appeal through the independent POPLA ombudsman. It's an easy and relatively user friendly online process - you present your evidence and write your appeal (it helps to take some time writing this beforehand. Sites like Pepipoo have templates to use but I figured they'd have seen a thousand copy-pasted appeals so wrote my own using the template as a bit of a guide). They then go to the parking company and they give their evidence. You have a chance then to refute anything they've said, then it all goes to the ajudicator and they come to a decision. In my case, I won. The nice thing about that is it costs the parking company more money if they lose as they haver to pay a fee to POPLA. I figured if I had lost the appeal the worst case would be that I'd have to pay the non-discounted "parking charge" so might as well give it a go. If you lose the POPLA appeal the next step is the courts. Whatever you do, don't ignore the letter. There's a lot of people incorrectly believing that you can ignore these "parking charge invoices" but that's not the case any more.

It happened to me at a car park at a bowling alley i went to and I complained because the staff hadn’t warned me I had to pay and the screens I had to put my reg number into weren’t obvious and they halved it.
The car park wasn’t anywhere that I thought any one other than customers would use so hadn’t even considered it might have been pay and display until I got a letter in the post

They are also really good at not sending out letters until it gets to the court stage, the first we knew about ours was a court date, hadn't heard a thing prior to this. Staff in store said they couldn't do anything at that point. Luckily I had my credit card receipt showing I had been in store. Went onto Facebook and posted up on their page what I thought of them letting these scum bags exploit their customers and it was cancelled swiftly.

someone I know had a situation recently where her permit ran out, she'd applied and paid for another one but hadnt received the bit to put in her screen. She parked in the usual place and received a ticket with a hefty fine. After afew phone calls she was told not to worry about it, but still kept receiving letters threatening court action. More phonecalls made, once again told not to worry about it, yet still received the letters that were getting more and more forceful. By this point she'd receied the permit that shed paid for before she got the fine. She didnt have to worry about it, but the people sending the letters were in a different office and it seemed the messages wernt somehow getting through. If there wasnt people around to advise her, she probably would have paid the discounted rate within the first 2 weeks. Not the same situation as the OP's, but it shows that the 'fines' arnt always straightforward.

Take a look at the code of conduct, if the signs in the car park did not reflect what they fined you for you may have chance but expect a whole lot of hassle threats of court action etc, to be honest I know it really hurts to give scum like this anything but the easiest option is to pay the initial charge.

Quick update
I did not pay the fine, after talking to the Manager at the ‘Chain’ Hotel, he has agreed via email that as the Hotel was closed I could not record my vehicle registration..... I have submitted this omission to PE ......
Let the battle commence.....

I have submitted this omission to PE ...... Let the battle commence..... Ha! Good! If they persist in the face of this then I think you'll have a pretty good case if you take it to POPLA. The way I see it, the absolute worst that will happen by taking it as far as a POPLA appeal is that you'll lose and have to pay the original fee. Good luck!
