Hi All, I drove this car for about year after purchasing from Newcastle in August '13 for £1300, put it through it's MOT in October '13 with no hassle and a £90 bill. It had Tax and Test until October and had interest on other websites such as Swapz, where it was listed for £1400. Going forward, said friend intends to buy the car for what it was worth before he got his hands on it, and that is where i am struggling. On one hand I wouldn't want to be a dick about it and either make him claim on insurance or charge him more than i would have ever got for it, but on the other it was a perfectly drive-able little car with T&T for 4 Months - prices on the web range from £850 for a tatty spares/repairs job, to over £3k for a nice example So I ask you! what do you think this is worth? Both before and after the 'incident'? Cheers

Why not just get back the £1300 it owes you? After all, he`s a mate and you wouldn`t be losing out.
As it stands now, it looks to be a parts car only, so probably a couple of hundred quid.

Update!
The car has been sat on a driveway for the past week, registered to me, and not much has been decided!
I was told a "Cappuccino Guy" was found on facebook to give a valuation. So prior to taking photos for this, the tape was ripped of the sills and any rust had been bashed through (No pictures of the rust or sills before this as i wasn't there! I just turned up in the evening to see rust everywhere and was told they were going at it with a hammer)
The "Cappuccino Guy" said from the pictures it should not have been on the road, and must have had a dodgy MOT. He valued it at £400 before and £250 after the accident
What do you guys think of this? Obviously without decent pictures of it before it's hard to be sure of anything, but it just sounds a little dodgy to me!
I am tempted to disregard this and tell him to break it for as much as he can, then give me the cash to make it up to a grand

I might be misunderstanding your posts, but it sounds to me like you have pretty suspect mates.
If I was in your situation, I know my mates would cough up straight away with the cash, and would be happy paying me what the car owes me, after all, you did do him a favour by lending him the car in the first place. They certainly wouldn`t be trying to get away with paying me a minimal amount, if this is what he`s doing?
IMHO, it`s really quite simple. He either pays you the money it owes you, and keeps the car to break/scrap/do what he wants with. Or, he breaks it himself pretty sharpish and makes the rest up in cash. Any other agreement shouldn`t even be considered.

I suspect your "mates" have found another Cappuccino which has been in an accident, and are making out that yours has been damaged. Why!, well think about it, they will give you a couple of hundred quid for your "damaged" car and once they have your V5 your car will resurface as undamaged and sold for a pretty penny.
I say all this because the damaged car in the pictures doesn't have a reg to comfirm it's yours, and most importantly - in one of the pictures you can see your car in the corner next to the woman in a dress.
What i would be doing is heading straight over there, and checking the vin numbers on the V5 are the same as the ones on the car.

Certainly sound very fishy, as said above any friend of mine would have either paid to get it back to straight, or paid the asking price/ valuation etc. job done and a beer or two in the pub. no hassle no worry
you seem to be getting done over somewhere down the line

Erm what everybody else has said, if i'de borrowed a mates car and done that i wouldn't be trying to knock you on price. £1300 i guess was a fair enough price, is it local to where you are now or is it down in London still?
The plate thing is wierd too, why rip the plates off unless you're trying to hide something

Hi again,
I appreciate the concern that it could be a huge con! I am 100% that the car is mine, I have a photo of it sitting in the ditch with the number plates attached, but thought better of posting it online as any damage caused to council/privately owned property could come back to me, but they were removed for the journey back to where it sits now and are inside the car ( The similar-looking red J car in the background is an MX5 - nice detective skills though)
to give a better representation of the car, it is rotten underneath and you can now feel the carpets from the exterior of the car through a hole in the o/s footwell, o/s/r brake pad was down to metal on metal, and the tyres barely legal. The Mate who borrowed it thinks it would have been irresponsible to carry on driving the car, and i gave it to him knowing it was unsafe, and doesn't believe he was driving like a tw@! Any tapping of the loose / non solid material on the sills was well within what an MOT tester would have done. A welder guy we know reckoned it'd cost about £300 worth of welding to get through the next MOT in October, and nearly £600 all in all.
It's been suggested we get a mock MOT and get who does it to pretend the crash damage wasn't there, and that the sills were taped up to get a quote for what it would take to have got it through the next MOT in October, I can't see any value in doing this though
The good news is RetroWarwicK want's the engine/gearbox/prop to go into a project of his own - so the guts of this beast will live on!

At the end of the day you didn't force him to borrow it or to drive at gun point, it is down to the driver solely to determine if the vehicle is fit to use or not. The fact that he put it in a ditch says there was a lack of attention going on, if it had been down to a mechanical failure he would have been busy telling you it wasn't his fault. Tell him you want to claim on his insurance.
From your description it doesn't sound terminally rotten at all, most older vehicles will need welding at some point to get to MOT standard, it just sounds like you're going to get screwed to be honest.
Tyres are either legal or they aren't - really doesn't matter in this case a few more mm of tread wouldn't stop someone driving off the road.

Regardless of condition, it was worth £1300 to you. Your mate crashed it, so he owes you £1300 - he can break it up to get some of his money back.

Good luck explaining that to the judge! Something here is as bent as a banana.
Agree with others on here, it's simple. You break it, you pay for it. It was worth £1300 when you lent the car out, so that's what you want back. All this Mr Cappuccino, he said, she said bull curse word is irrelevant. £1300 cash non negotiable, dispose of the wreck in your own time.
If this guy's a real friend he should be bending over backwards to resolve this, not trying to wriggle out of it.

Sounds like you're about to lose a 'mate' here. He's been driving your car like he stole it - he took it off road not you - you can never be held liable for any damage he did. As said above, all the rubbish about the condition of the car, who said what and when is irrelevant. The car was worth £1300 to you. That's what you should get back. If you want to take (say) a grand plus the car, that's up to you.
Your chances dope getting anything other than the car back are slim though given your 'mate's' attitude so far. Are you prepared to take legal action? If so, get on with it, otherwise get the car back, break/sell it, chalk it up to experience and move on.
