I just recieved an £80 fine for not taxing a vehicle that was sold on a month before the tax expired.
The car in question was sold to a dealer and is in trade he kept the logbook and sent of the relevant portion to the DVLA I have confirmed that this was done. I also wrote to them at the same time saying the vehicle was sold and giving the details of the company it was sold to.
I later recieved a final reminder for taxing the car and sent of the relevant part of the form declaring that the car had been sold. So the DVLA have now been informed 3 times of the transfer of this vehicle and they are still trying to fine me. Ive a good mind to invoice them the cost of postage for now sending this same information 4 times.
Where do I stand here do I have to pay this jumped up fine that I don't owe or should I let them take it to court and fight them over it.

Don't pay it, whatever you do. I think they take paying the fines as an admission of the offence so you'll not get it back even if they later agree that it was their error. Write a letter, explain fully what happened, include all the dates and whatnot and copies of any documentation you have. Post it to the DVLA. Do the same the next day, and the next day, and the next day, and the next day. It'll cost you a couple of stamps and a couple of printed pages. At some point, someone in the DVLA will get the letter and do the right thing with it. You'll stop receiving the demands, not apology will be given.
This process works with changes of details to cars, trying to get new engines recorded, trying to get vehicle keeper details, trying to get complete vehicle history details. Basically anything to do with the DVLA. Keep sending the same thing in until the day it hits the desk of someone who cares and they do what you need them to do.

^^^ Worth a try! Just a note though, it`s the responsibility of the registered keeper to send the yellow trade section of the V5 off to the DVLA, not the trader who bought the car. I`d not mention the fact that you left the trader to send it off if I were you, as knowing the DVLA they will concentrate o this fact, and could even do you for more than just a fine. The DVLA are an absolute pain in the . I sent off the renewal for my trade plates at the end of November (current ones expired at the end of December, so plenty of time), and it has literally come through yesterday. When I phoned at the start of January to chase them, all they said is we have too many to process, so you need to wait. I argued that I use them most days to drive untaxed cars, and all they said, basically, was tough luck. If you get caught, you`llbe in trouble.

I had a similar case my self , i sold my first car [ mini ] and when it came to filling in the logbook he said ' he'd send it off ' . I got a letter later about taxing it as he hadnt sent the book of and i got fined . I managed to speak to someone at DVLA once about geeting a replacement driving license processed quickely and they were amazingly helpful . I was provided witha internal number to a high up manager who dealt with it personally and i got the license in 4 days rather than weeks - i suppose I'm trying to say they do try to help . I would see if you can phone them and try to nicely explain the situation .

I realised afterwards when checking my other cars logbooks that I should send off the V5 section and followed the instructions given for selling if you have lost the V5 hence writing to the DVLA and informing them the vehicle was sold, who to, and what date. That was sent the day after I sold the car so I don't see how they could argue they weren't informed. I do know 100% that the yellow slip was posted to them.

You really need to talk to some one and get above the basic shop floor people , at least to ask if the fine can be halted while its investigated properly . Unfortunately your probably in the same boat as i was , if you have done something wrong wether intentionally or not its the same . I wish it wasnt but thats the case .
