i had given my motorbike which is in my name, to a friend who needed to borrow it as a get around. Now it looks like he wants to keep it, no contact from him. he doesnt even answer the door to me. i only had one key to it. any ideas how i can get my bike back without violence?
obviously he no longer is a friend, i don't want to call the Police unless i have to or is that my best bet?

This thread will almost certainly be looked. But if he isn't your friend, then don't do him any favours and get in touch with the popo. he doesn't want to do it the easy way.

Right,attend at your local police station and explain the situation to them. Then say you are attending his address to retrieve "YOUR PROPERTY" can you request an officer to attend as you fear for your safety. That way you have the law on your side and hopefully retrieve your bike. Good luck.

why would it be lying? theft is theft mate, regardless of how your ex-pal got the bike.

The definition of theft is :
(1)A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it; and “thief” and “steal” shall be construed accordingly.
(2)It is immaterial whether the appropriation is made with a view to gain, or is made for the thief’s own benefit.
It is not a case of TWOC , taking without consent or TDA taking driving away.
Now you have had issues getting your property returned you can honestly assume that when he appropriated your property he never had the intention to return.
Because it is not clear cut I would seek advise from both the police and citizens advise bureau. The reason I say this is that without more information about the initial agreement you are verging in the grounds of a civil dispute.
Whichever route you take take "reasonable steps" to resolve the issue amicably. Visit his home on three seperate occasions at different times of the day and leave a note. (Make a note of when you do this). Also write to him several times via recorded delivery to ensure you can prove he has received the letter.
This way if you have to go to the police you can show you have taken reasonable steps

When I feel pain, I speak to a doctor. When my central heating fails, I call a plumber. When I need legal advice, I don't ask a bunch of randoms on the internet. If you are serious about his, you need to go about it seriously. Legal advice from Citizens Advice or a solicitor is your first and hopefully last step.

The bike is his,in his name and I'm sure if someone came to me I would be obliged to yes ask for further evidence of ownership. But having the law on your side greatly assists. Take my advice and tell the police from the outset. Ask for an officer to attend the address with you to prevent a breach of the peace,speak to your ex mate and request the bike. Good luck.

Getting the police involved is tricky (and pointless) for the reason I mentioned, the V5C being in the OPs name doesn't make the bike his, it makes him legally responsible for taxing it. The "mate" has not done anything legally wrong, it is not TWOC so the police will only go to prevent a section 5 occurring.

Nope he hasn't, he use to work with me. I've now found new work so don't visit that site. When I was on site the story was always ill ring you after work or come round mine.
