Two weeks ago i was undertaken by a driver who then clipped my car as he pulled back into my lane
My insurance company tell me he is denying knowledge of the event
The damage is such that it's taken the top coat of paint off over my ns wheelarch
He was in a van with black rubbing strips so not sure if it damaged his van
There was only me in the car
Is there any likelihood of getting him to pay for my damage?
Ta,

Go to the police report him for dangerous driving, show them the damage give them his registration number. failing that get a hummer and hit is van, I hate people who refuse to except they are wrong.

The police will do something about it if its reported, although I guess they already have if his details have been procured. Wether he acknowledges it happened or not is incidental really, a similar situation happened to me where but I was accused of being in an accident that never happened, and because I insisted I wasn't there I ended up getting prosecuted with failing to disclose driver at the time of incident (because I wasn't going to admit being there when I wasn't). If he won't admit to it, that's what they'll do.

6points and a 500 quid fine. I honestly thought it would never go anywhere so wasn't too worried about it, then 3 months after the incident she majicked a witness out of her ar$e who corroborated her version of events almost word for word, unsurprisingly, so instead of being my word against hers it was two against 1. I was convicted with no appeal (which I didn't think was fair, mind you, the whole curse word thing stank from start to finish). Basically being honest gor me seriously screwed over.

£3 disposable camera from tesco. No battery worries etc. All our trucks have them in the cabs. Carry one in the car now. Are there any witnesses? Area with traffic cameras? Local busineses with cctv>?.

Sorry but with him denying it and no witness there is no chance of any conviction or insurance claim. The ONLY defence in an incident like this is video evidence from a dash cam or similar device. Despite what some may say there are no data protection legalities, no requirement to display a 'camera recording' sign and the footage doesn't need to be time/ date stamped.

If you make a complaint to the Police they're obliged to at least investigate. The Police are the only ones able to question him with a view to proving where he was when the accident happened, which will either put him in the clear or put him in the frame.

The police won't act without an independent witness unless there are injuries which would have been reported within 24hours. .
