I helped a friend of mine find a new car a couple of months ago. We found him a car he was very happy with, at a local dealership and because we could get more for the old car it was sold privately. Due to the continous insurance enforcement rules the old car was sorned and the tax disc which had 8 months remaining was surrendered the day the new car was collected, and the dealer was very kind and helped him fill in the forms.
This is where it gets nasty. A couple of weeks ago he recieved a letter from the DVLA telling him that he could not claim the refund of tax as that was only claimable by the registered keeper. This was very confusing as for the last 10 years they have been sending him the tax reminders. On looking at the letter a bit more closely they have spelt his surname with two "L" instead of one it should be so I can only assume this mistake was on the original form filled in by the dealer. Apart from feeling a little hard done by he was prepared to accept this but not what happened next.
This morning a letter dropped through the post fining him for not informing of a change of keeper. There had been no change of keeper until a few days ago and the log book was duly posted recored post the same day. What on earth can he do about this does he have to just pay this fine or can he fight it? Bear in mind the gentleman involved is 90 and suffering from the beginnings of senile dementia.
