hey guys. firstly this isnt me, I'm asking on behalf of a friend as he's tried some other forums and theyve just been ...well a**holes to be honest. but he's really stressed over it and doesnt know what to do.
Back in November last year he sold a vehicle. He'd only had it a couple weeks and hadnt had the logbook through yet, so he gave the buyer the new keeper bit so they could apply for the logbook in their name.
hadnt heard anything so assumed the new keeper had applied for the logbook. but a couple weeks ago (so 5 months after selling it) he got the logbook sent to him in his name. Emailed DVLA and they said he's still the registered keeper. So either they've cocked up or the new owner hasn't applied for the logbook. more importantly why has it taken 5 months for them to send the logbook in his name? slightly worrying.
problem is he doesnt have the details for the new owner because the number that he was given doesnt work now
whats the next step? he hasnt seen the bike in 5 months let alone being the owner of it but DVLA are going to hold him responsible for any fines etc when he doesnt own it any more. anything he can do (legally haha - so not the fake name/ address idea) or is he stuck being the owner of a bike he doesnt even know the location of.
cheers guys, hoping someone can help because he's a good mate and this is really stressing him out.

Ring the DVLA.
They really are the only ones that can put him straight, I would imagine they try and turn it back on him with the "did you not chase us up after not getting confirmation within x weeks"
Well of course not, who does? and in any case, there's not a lot you can do at all!
being a bike probably makes it a bit more tricky, as its even more likely its in millions of bits all over the country, or just million of bits in a shed somewhere.
has it been taxed since?

Its not the "right" thing to do, but the simplest solution is to send the logbook off, having filled it out with false name and address. Bike gone, V5 gone, worries gone.
Without the details of the guy who bought it, there is nothing anybody can do. No way of contacting him, no way of getting a correct v5 to him....what more can you do?

So he did have details of the new owner? Even if the guy doesn't live there any more, I'd say that's irrelevant. Get him to fill in the last known details and bosh it in the post. Then tell him to do it the right way in the future. I sold a curse word mk4 Escort for peanuts a few years ago. It had about a months Mot left and was never going to see another. Similar situation to above, and after 3 weeks I received the first of 2 parking fines which the new owner had incurred. Long story short, it took serious work to dog myself out of that hole and convince the relevant council that the car wasn't linked to me at the time. Moral of the story:Do it properly!

he's trying to get the details out now see if there were any more details. was saved on his phone which broke so he's just bought all the parts trying to fix the phone just to get the details.
he didnt have the logbook so gave him the new keeper bit so the new keeper could apply for the logbook. yeah it was a mistake but we all make mistakes.
but why did they send the logbook 5 MONTHS after he sold it (so nearly 6 months after he bought it) why suddenly send the logbook out if he's apparently been the registered keeper all this time? that is what is puzzling me. surely it cant have got lost in the post for over 5 months

I've never an issue with log books,always got the 'you are no longer the keeper' letter . The 'suspicious' side of me could conceive of 'new owner' registering it back in your details so he can 'bend' a few laws with it,and not get any tickets, but thats just me

thats what I was thinking optimus. but in new development surprise surprise he got a £100 fine for 'not being insured whilst it was taxed' only got the logbook a couple weeks ago so didnt even know it was registered in his name. But he didnt have any 'last chance' warning letters so how was he supposed to know it was taxed but not insured. he hasnt seen the bike for 5 months.
although thinking about it there is the possibility that the new owner hasnt even bothered to apply for the logbook. what I'm thinking is that when my mate bought it the previous owner didnt send the logbook off. now not being insured and still taxed I'm guessing DVLA have sent the previous owner the warning letter and they've quite craftily then sent it off thus putting the blame onto my mate.
really hoping he can fix that phone get the details of the buyer now.

I had similar problems once . Buyer wanted to get away so i filled the log book out and he said he would post it and never did . I got a tax reminder through and spoke to dvla explaning what happened and had to pay a fine for not declaring i had got read of it . Its odd that it took so long though , longest i had to wait was about 3=4 weeks .

You could query the 5 month delay, but you may just as well stand and shout at a shopping trolley in Tesco's car park (other supermarkets are available) and you'll get pretty much the same level of service I agree, your logbook is the only proof of anything, try writing to the DVLA first, if no beans I would go to the police station with everything you have and explain the situation, if they are in a good mood they 'might' help you out. long shot if your friend doesn't know the name and Addy of the guy who has it now I have never had any probs like this so can just surmise

Simply write a letter stating the date you sold the vehicle and that you want your name removing as the registered keeper, send it recorded, job done.
I don't know why people get wound up over this stuff, its that simple.
