letter ref CR1, anyone got one? apprently despite selling my pug 106 (anyone mind that?! ![:D](//storage.proboards.com/forum/images/smiley/grin.png) ) and sending of V5, as you do, theyve still thought it prudent to bill me for its unlicenced action between september and now. seeing i sold it in sept... so i pay now, fine of £80, (reduced to £40 if got in 28 days), plus £20 of "road fund" licence for 2 months, or face court, £1k fine. YEAH. came to my mum, car was in her name for insurance purposes, luckily she gave it to me rather than be a conformist pleb ![:)](//storage.proboards.com/forum/images/smiley/smiley.png) go mommy. answered with this: Dear Sir/Madam, I am writing in response to a letter I received from yourselves Ref: CR1, Enforcement Ref: xxxxxx, DVLNI Ref: NIVIxxxx, Date 10/11/2006. Vehicle Registration Mark is HUI xxxx. It alludes that I have kept this vehicle for two (2) months whilst unlicensed. This is completely untrue. This vehicle has not been my property since September. Between the 14th and 21st September this vehicle was sold. The V5C(NI) was, in accordance with DVLNI regulations, posted to County Hall, Coleraine, complete with the new keepers details and signature and date of sale/transfer. Your letter insists on evidence, however, as I have sent the V5C(NI) to the DVLNI, and as yet have received no acknowledgement, there is no evidence available. However, should you choose to check your records you may well find that what I have stated is in fact accurate. As such, I will not be held responsible for the “road fund” licence and/or SORN discrepancies. Furthermore I will not be paying any kind of penalty for this vehicle. Further to that I may add that this does not fall into the ‘disposed of’ category on this form. This vehicle is the sole and entire responsibility of its new owner whom I neither know nor have any form of contact with. Any further correspondence relating to this vehicle will not be answered. Has a similar experience after I sold a car and foolishly let the V5 go with it. All sorted in the end with letters from myself and the new owner who fortunately is a mate (Hi Matt!).
Do you have any way to contact the new owner? May help if you both raise merry hell but it took a barrage of letters before they took any notice.

I had a similar problem myself with a BMW I sold a couple of years ago. Posted a very similar letter and heard no more about it.

A lot of the time a formal worded letter is enough to scare people into coughing up and further lining the pockets of the DVLA bandits. Good on you for telling them (in a formal manner) to f*ck right off.

Looks perfect to me....... I've been caught out by missing the odd SORN declaration and vehicle scrapped every so often and I always find the I bloody did letter sent etc etc nomally does the trick!!!

Correct. Now that the DVLA/VOSA/-WHAT-EVER-THEY-CALL-THEMSELVES-AT-PRESENT is a private concern (and has been for a few years now) their job is to make money 'by hook or by crook' so to speak. heres 2 letters I've had to write to the DVLA recently;
Dear Mrs Wooley With regards to your letter dated 5th Nov 2006, concerning my car OV51XZT
I was very surprised to recieve this letter from you, as this is the car has a tax disc.
I belive there to be either an adminstrative or post office error, as I have a tax disc on the vehicle as per the attached pictures.
I bought the vehicle around 21st August 2006, from the previous owner. I bought the vehicle with the tax disc & have used it on the road since then, therefore never requiring SORN.
I hope that the above information assists you in this matter, & hope to hear from you soon regarding the prevention of any fine & confirmation that my enclosed proof has been recieved. Please do not hesitate to contact me should you have any further queries. Best regards Jamie Yates
Dear Mrs Wooley With regards to your letter dated 4th Feb 2006, concerning my car H929KSD
I was very surprised to recieve this letter from you, as this is the 1st contact I have recieved from the DVLA regarding my car.
I belive there to be either an adminstrative or postal error, as I had sent off my SORN declaration before the 30th September 2005.
I called the helpline 0870 2407779 today after recieving this letter (having only just picked up all my post, as I have been away from home & staying at my girlfriends recently). I explained the following & the person I spoke to has asked me to put this in writing to you, in addition to forwarding a secondary SORN form (which I enclose).
• I sent my SORN document for H929KSD prior to its tax expiration at the end of september 2005 via Royal Mail Post. • The car had been involved in an accident in July, & had been with the bodyshop untill the last week of August, in order for me to use the car on a 1 week holiday. It then went back to the repair Bodyshop mid September & remains their today. • The car would also have been off the road from September anyway, as this car is taken off the road every winter. If you see from my DVLA records, I am very aware of the SORN documentation, as I declare cars SORN regulary (due to them being used in the winter / summer only). • I did not recieve any previous letter requesting the payment of an £80 penalty.
The person whom I spoke to said that they have now prevented any legal action on this matter, which I hope you can confirm.
I hope that you can see that something has occured that has; a) prevented my SORN notification from reaching you b) prevented your 1st notification from reaching me.
I hope that the above information assists you in this matter, & hope to hear from you soon regarding the prevention of any fine & confirmation that my enclosed SORN has been recieved. Please do not hesitate to contact me should you have any further queries. Best regards Jamie Yates

i've noticed another 'up-cock' our wonderful dvla have made.you can declare your car sorn online,all you need is the remider letter.you log on the relevant page and it says to input reg etc,then it asks you to insert the reference number in the yellow box and shows you a little diagram of where it is on the letter,trouble is the poxy yellow box is utterly blank,and this has happened twice,so i was rendered at the mercy of the post office,who took a month to deliver my v5 after i changed it into my wifes name!

I had a similar letter years back, I think it was before SORN was created, asking why my first car (a brown austin allegro) was being used without tax. I sent them reprints of the photos I took of the stripped shell on the back of the scrappy's truck, being held in place with the hiab arm which had crushed the roof in. I also sent with it a photocopy of the V5 filled in as scrapped (always copy a document before sending it to an official body or other incompetent agency such as insurance company) I assume that was sufficient evidence as I never heard back.

dvla suck, i make sure anything important i send (inc stuff when i got caught by a greed camera) is sent recorded delivery. that way it's a lot harder for them to say they didn't get it. wish they'd just check their facts though, I got a letter saying something about not SORNing my (my borther's technically) fiesta, when it had been done for a few months.
