I stripped a car down to the bare shell, and this shell has now been taken away by the scrap man to be turned into bean tins. Trouble is, I still have the v5. What do I do?! There used to be a tick-box to say you've scrapped it yourself but this has gone with the new V5C, and they now require a certificate of destruction from a certified yard. I don't have this. Am I doomed to an eternity of SORNing a non-existent car every year?! I don't fancy "selling" it to a made up address or any shenanigans like that as it'll no doubt come back and bite me on the ar$e. Can I "permanently export" it? I'm sure bits of it will be exported in some form... Any ideas?

I think you can still get away with sending them a letter.

You will have informed them (send it recorded/signed for or get proof of postage) and so the responsibility will be theirs to do what they will with the information.

Nope wont work all they will say is "prood of delivery is not proof of contents" Just had this with the DVLA over a change of engine i sent to them 2 months ago to make my truck LEZ complient, the recorded delivery shows as deliverd but they refuse to acknolledge they lost it and basicly called me a liar and claimed the envelope was empty

But if that's the case, how can ANYTHING be proven since DVLA will only work on from posted documents? Proof of delivery and keeping a copy for your own records is better than nothing at all...

This country is slowly but surely been run into the ground by idiots! Why do things have to be so hard common sense just does not seem to exist! The last car I scrapped I cut it up myself into many small pieces and weighed it in. A few photos would have certainly have proved that car no longer existed!

it's possibly to try and stop unregistered (i.e unlicensed) people scrapping cars.
I know what I'd do though O.P, get the name and address of the bloke that scrapped it and send the V5 off in his name. Do NOT sign his part of the V5 though as that's fraud, just send it off with a cover note saying he didn't sign his bit.

No, it's just the usual fuss about nothing. Send the v5c back to swansea with a letter saying you have scrapped it yourself. They will write back saying "OK thanks!" and you aren't the keeper any more, job done. All that has gone is the "scrapped" box that numptys used to love ticking when they had actually sold the car on.

With regards to the documents lost in the DVLA system, there was a precedent against the DVLA on this. I believe it was down to somebody arguing over a SORN fine - the defendant argued that the DVLA could lose things in their system and they were unable to prove otherwise to the court. Worth digging up if you find yourself in a position with them.

DVLA vs Collins (clerkenwell, 2009) and DVLA vs Peck (horsham, 2010) are the two rulings that make them panic

Obv it BS and i know they know that i know it is but if you get shirty on the phone they just put it down on you. You know the REALLY funny thing? the new V5 arrived today! all changed to petrol but it's still on the LEZ as non compliant, i see another afternoon of waisted (and frikken expensive) phone calls in my future The DVLA are a law unto themselves and (the company itself) is just curse word, seriously if they were an escort agency they all still be virgins, if they were a brewery they'd miss thier own crimbo pissup ! tis why i usually use the (exellent) local offices, shot meself in the foot this time posting it You don't actually send of the cert of destruction the frag yard put it on the database directly the cert is for your records, OP do you know anyone who works in a frag yard can do it for you ??

Thanks for the replies, guys. I shall write the DVLA a letter and enclose the V5C. I'll report back with what happens.
