First off all, yes I must be some kind of massive fool for trusting the lying C**t but please don't flame me I feel bad enough as it is, I'm an honest bloke and as such, I tend to believe things people tell me. So I went to buy an SJ on Monday night, the missus and I took the camper down and stayed the night as it was quite a trot. The car was advertised as coming with a fresh MOT. (issued on Monday) The light was fading fast as I first saw the thing and I was quite excited and eager to get my hands on it, THe guy assured me that he know it was a goodun and had been messing with Sjs for 15 years, my excitement allowed me to overlook a few minor issues that had alarm bells ringing (heart ruling head) I was thinking I could sort without any trouble. I looked at the MOT to check it was valid and gave him the cash. You know how it goes, the more time you spend in the vehicle the more you notice. I put 6 months tax on it and drove it back the following day. (today) Closer inspection today reveals these issues..... Front number plate incorrect (reads F684 DKL, should be F634DKL) O/S rear wheel bearing, Excessive play N/S rear wheel bearing , Excessive play X4 Tyres scratched and cut, X1 tyre has large chunk missing from tread (see pic) N/S front caliper partly seized Revesing light non working Fog light not working O/S and N/S Front indicators not working Fuel feed and return lines badly perished Hole in drivers footwell O/S wiper blade falling off Spare wheel not secured properly Now there are probably things I havn't noticed that would crop up on an MOT on top of that list. The MOT comes up as no advisories on the MOTinfo page. The garage that issued the MOT is The Name Changed MOT centre Unit 3 VOSA Informed Garage Not Really Here Madeupville MO7 F41L (^ Garage details edited) I'm in a bit of a dilemma now as I find myself with a vehicle which is quite frankly dangerous, over a grand light on the cash side of things and If I report the sorry SOBs to VOSA I will most likely find myself without a car as they may need it for evidence of something along those lines. I can do most of the work myself (bar the new rear bearings) but all in all I reckon a worthy garage would charge not far off a grand for the work required. What shall I do.. BTW, Photos...

You can appeal! You can appeal the result of an MOT whether you think it should have passed or failed. Any MOT station should be able to print you off an appeals form. Just fill it in and VOSA will write to you asking you to bring the vehicle to a neutral MOT station. If they think you are right they will investigate the MOT station who passed it. The tester who passed it will be suspended from when your appeal starts until VOSA decide on the outcome.
The important thing is not to do any work to the car until VOSA have had a look, even if you do stuff that doesn't concern the faults you mentioned, the car has to be retested in the condition it was first presented in.

I'd assume your consumer rights are naff all being a private sale. but you need to go back to the seller and report to vosa... That is shocking and could have killed you...

Firstly, I would satisfy myself 150% regarding the vehicles real identity - what kind of curse word-nut puts the wrong numberplate on a car?
Secondly, I would phone the garage and ask to speak to the owner/manager. I would tell them that I had just bought a car that they had passed within the last few days, and I had serious doubts as to hether it should have passed. I would explain that I am perfectly willing to get it re-tested locally to provide a definative list of faults that were missed, and I would encourage them to repair or pay for the repairs else I woiuld hand the entire matter over to VOSA and let them deal with it.
I would also bear in mind that the reverse lights are not a testable item, and that its perfectly possible that the previous owner fitted different wheels and tyres for the test, then changed back to these old ones to sell the car on. This is not really provable one way or the other though, so be prepared to take the loss on that one.

you may have to play it a bit clever to get what you want. you could just go straight to vosa and report, but as you say you may need to leave the car with them as evidence, and wont stand any chance of actually getting any money back or getting at the seller, as itll be his matey tester who cops it. id guess you want ether a full or partial refund from the seller, who id guess again is going to tell you where to get off after selling you such a heap ring him and let him do so. then, ring the garage, speak to the tester who issued the cert- (probably over the phone by the looks of it!) and tell him hes gunna loose his job/testing licence over it as vosa are coming to collect the car next week to re-inspect it as the seller has told you to swivel. (remember to show him the pics of all problem areas, as id put money on him ahving never seen the car) i bet mr. tester goes and has a 'quiet word' with mr. seller and this situation will magically resorve itself with either a full or partial refund, as no-one wants to be un-employed at the minute. if it doesnt, get vosa in on it.

Suspect, as above, seller has changed wheels - he's 'been messing with SJs for 15 years' so quite possibly has a spare set.
Step 1 - Talk to seller Step 2 - Talk to MOT Station Step 3 - Report to VOSA as even if the SJ had different wheels/tyres it should obviously have failed on numerous other points.

I had this nearly a year before I noticed it had been fitted with odd number plates... I'd report the garage as the others have said, What if you had a blow out with with your kids in the car (If you have them that is).

Had a similar episode the other month - my local was overbooked at MOT time so I had to go elsewhere. Bearing in mind the previous year's advisory sheet mentioned a front shock pi55ing out oil, the rear reg plate was heavily damaged with no bulbs, and the wiper blades were split and not clearing the screen... I was a bit shocked by the pass with no advisories. I won't be going back, needless to say!

I thought that even private sales were protected ? I was told 14 days and you could demand money back, I would check on that with trading standards,
and yes, report the garage

I bought a car that had M509 VHV on both the plates, but it was inface M509 VFV (or vice versa?)
Didn't notice until I'd had it for about 6 months!

Had similar issues with my MK1 golf.
Ended up selling the car at a massive ball shattering loss.

id fix and forget.... i know its a tad curse word but if you report it chances are the mot is void.... decent (and by that i mean rust free) sj's are hard to come by, believe me i spent the best part of a year viewing sj after sj and gave up!! the faults you have found are relitively small although obviously very very annoying... just do what many people do and learn from your mistakes... we've all done it, and learn from it.... on the other hand you have a potentially very kool car

i bet ya anything the last owner was a mate of the mot tester.... its probably not common to happen there, and that being said they will use your car as the proof because of that... then as you have allready driven it away and done what you like to it... theres no proof at all that it was like that at the time of sale....

I've made up my mind,
That bounder will rue the day he took a backhander for this one
VOSA can have it to look at, then when I get it back I'll fix it up and get a proper ticket on it.
