How do the hot rod guys get away with having totally exposed tyres and wheels? Example....... I thought that wheels had to be covered with an arch or fender so that when viewed from above no tread is visible past the arch. Hence all the tucking and stretching people go into, to get wide rims on stuff. It's just I was a hot rod yesterday in Brixham and it had exposed (unarched) wheels front and back. Just wondered how it goes through an MOT?

Rodders seem to just run the risk and the more law abiding use cycle wings that can be removed once at or close to their destination.

Thanks mark. IMO its worth the risk, the rod I saw would have been totally spoilt by arches!

It goes through an MOT because the fenders are not covered by the MOT but by Construction and Use regs.

It goes through an MOT because the fenders are not covered by the MOT but by Construction and Use regs. So it'll pass an MOT, but traffic cops will put you over and tell you that your car is not road worthy is that correct?

pretty much the case. Some MOT testers will give you a hard time over it. So with all things like loud exhausts, exposed engines, etc. its good to have an "understanding" tester.

Its one of those things. If the guys got a brain and a heart he should pass it. technically. Thing is a lot of testers are looking out for their licence and some just hate modified cars. You could get a report to VOSA or all sorts these days. I've heard a few stories of stuff like that or refusal to test or just finding the longest possible list of things to fail it on otherwise (used to know of a garage which did this for any older cars anyway, they saw it as theuir duty to get as much "old junk" off the road as possible.) For various reasons I'd say it was probably best to have some facility to mount cycle fenders even if you hardly ever do.

You could always build one East Coast styleee California introduced a fender law in the fifties that had a weight restriction on cars that could run fenderless. It was always illegal in other states hence many "East Coast" cars having cycle fenders.

MOT vs Contructions and Use Regulations.
Some areas are covered by one, some by the other, both are relevant for road use.

The MOT does not check complete compliance with C&U though. If it did it would be a 2 day test costing £1000. Some MOT testers will say "not my problem" and wave you though with a non-compliance and some will take the view that they know its "dodgy" so they'll find some way of making the MOT test fail it.
Neither helps you if you get pulled by a VOSA van or a copper who wants your hide 'cos you're bang to rights really. Like me and those black number plates I got warned off on earlier this year. MOT never picked it up, but the cops did. And I guess the tester could have done something if he wanted to or though it was a problem.
Theres still human beings as part of the system so the system still runs with some variance.
