Hi just wondering if anyone has had reason to use small claims court for work carried out, or in my case not carried out, for a bodyshop? My car has been with a bodyshop for 2 years(!) after numerous failed promises of completion spanning literally 1.5 years I went to see the car, it was in bits, sat outside open to the elements, with no glass in! Interior is shot, floorpans are rusted out, god knows the mechanical damage.
I’m having a report carried out today by a classic specialist to assess damage, I have paid a small deposit, plus recovery costs both ways, and now the extra money involved in bringing the car back to how it was. Any advise appreciated.

What contract/agreement have you got with the garage? Have you paid any money? What documentary evidence have you got of this? What efforts have you made to resolve this matter? After answering those questions and assuming you get nowhere then you start with small claims. First stage would be a Letter Before Claim. Put the effort into making this compliant and factually correct.

Thanks vitesse I have private messaged. I have all the messages from agreement of work, agreed quote, over 100 messages over the course of 2 years with 20+ missed deadlines, pictures and video of the vehicle running and in reasonable condition at time it went in and now an independent report outlining damage incurred over course of 2 years having been left outside in the rain.

Sorry to hear of this terrible situation.
Just a point for consideration, does the garage look like they would have the money to pay you for the damage? Are the a limited company in which case they could be called Oddjob Bodgit and Scarper Ltd today and Oddjob Bodgit and Scarper 2020 Ltd tommorrow with very little if any liability to you.
If its a sole trader/non limited company then you may able to enforce any debt from court against their personal assets (if they have any).
I don't have a huge amount of experience but a mate of mine was in the opposite situation where a customer wouldn't pay for work done and he went to court, got a CCJ and the person had no assets they could levy against.

Solicitor is in the process of finding out info about them, they are still an operating bodyshop, and a fairly busy one at that.
