recently had an accident where turning into my drive after indicating and slowing to near standstill was hit in the drivers door by another car from behind , driver says didnt see my indicator and is in a hurry to get to work.
quite simple you would think BUT, i am third party only so my insurer says i have to claim of the others policy but upon calling them they tell me there client claims it was my fault ( obviously ) and i cannot claim, unless i prove to them it was there clients fault.
any expert advice please?

Any witnesses at all?
There are specialists that can deal with claims outside of the normal claim process - angel assistance used to be one if they still exist - usually need an independent witness though.
Good luck

After a recent claim I had I should be able to help from experience, but I cant. I was hit in the drivers door by someone who pulled out of a sideroad as if the junction wasn't even there. It was my right of way, he admitted liability but there were no witnesses, he even phoned me afterwoods and gave me his reference number, yet my insurance company (or his insurance company) couldn't verify the information to simply put my mind at rest whilst the claim was going through, and this was shortly before Christmas so paying my excess when I didn't really need to was a bit of a pain, even though I asked how on earth I would have his reference number if he wasn't willing to give it to me? Anyway once it was all over he was found at fault and I got my excess back. Even though everything was on my side, there was no recorded proof or witnesses so I guess the insurance company have to go through their standard processes and decide for themselves.
Sorry I cant help, but I cant see him saying that he was in a hurry to get to work is going to help him much.
