I would have thought that was all blatantly obvious . Take car for MOT , it fails, car is illegal .

But in the past I've been told that if the car still has a current mot its okay to use. Granted I'm not talking about driving from Lands End to John O'Groats, but driving the car around for a few days while you find time to fix it.
For example - take car for mot a month before the current one runs out, car fails, still have 1 months mot to use while fixing the car.

For years it hasn't been enforced
And most peoples idea of having your car tested upto 30 days ahead made sense as if it failed you had time to sort the problem out
Before computerisation this was ideal as no one would know you had a failure and a pass cert running at the same time
I guess that now anyone and his dog can see if you have had a mot online it's now easy to prosecute and raise valuable tax funds for our great governing bodies

I checked this out many years ago, was up to nine points and being extra careful. Once car was tested and failed current mot was invalid. That was at least 10 years ago. I read the self same article flashed up on my phone as news.

I expect a lot of the time in the past they would go through the mot without making any notes , ticking boxes etc , but now they have to do it all as they go and enter it into the system , hence it failing and also being down as a fail on the database which insurance , police etc use. I took my car for a mot a few months ago and asked them to check it all first then tell me what its going to fail on . The idiot then came out and told me it had failed ignoring what i asked . Either he was thick as mince or nowadays they now that once they fail it you will then have to leave it with them for the repairs [ incentdently £450 ] |

I've always taken the view that If it fails even before expiration of a current MOT test that its not obviously not roadworthy, so if pulled you could be fined/prosecuted regardless of mot status.

The mot is only valid on the day it's is granted anyway, always has been.

You don't have to leave it with them for repair. If there's time left on the previous certificate you can take it away and if not you can still take it to a place of repair. There are rules on timescales which allow for partial retest (subject to criteria) and fees all shown on Gov.UK.

I don't think the old mot becomes invalid you're just wide open to a defective vehicle notice or a construction and use infringement.
Anyway you wouldn't knowingly drive a defective vehicle would you? Other than to a place of repair obviously.

TBH, Id be amazed if, between the point of a failure and you getting a tug from Plod drving the car back home, the system would have been miraculously updated to show the car had failed.
Obviously, I could be wrong and the system could defy all the odds and actually be ultra efficient.

We have always had guidance while policing that if a vehicle is presented for MOT before the expiry of its current one and fails, the failed MOT is its "current" MOT, i.e., it doesn't have one. How could a vehicle be tested, found to be defective in some way but still rely on its last MOT? Granted, in NI, its government testing, so no remedial work will be carried out by the MOT test station.

This was how I thought it worked anyway! I've got 2 cars with MOTs in Jan...I'm going to put at least one through in the summer (as it's a nicer time of year to fix stuff) knowing that if it fails, the existing test is no longer valid.
I believe driving home even after a failed MOT is ok (as it falls under the condition of travel to/from a place of repair).
I've once been fined for no MOT when it was a genuine oversight. I was broken down at the side of the road and a police car gave me a ticket as the aa were fixing it...great day that!

Well this thread has been an eye opener for me as I was always of the above opinion - I've taken quite a few cars to MOT, had them fail, fix them and take them back for retesting. Granted the garage I use is less than 2 miles away from my house and along single tracks and back roads so the chance of being pulled by plod are minimal but good to know... |

The mot is only valid on the day it's is granted anyway, always has been. Not strictly true. The MoT is a declaration that the car was roadworthy to the required standard on the day it was presented. The MoT is valid until its expiry date. |

Can you still drive it to a place of repair ie home? That's what i have always done when any work needed has been something i can do my self at home.
