Bought my 156 last sept. in the advert it said nothing about it coming with or without the tax disc. when I saw it & bought it the guy said nothing about it.
having had the car for a week, i got a call from the previous owner saying he forgot to take the tax disc - "what - sorry mate, no chance, you didnt mention it, you didnt take it, you sold it to me "as seen"."
he spits & curses.
anyway 4 months later, I get a demand from the DVLA £1000 fine, your car is not taxed, I call the DVLA & find out the owner sent a "tax disc refund form" back to the DVLA claiming the refund WITHOUT the tax disc (I was sent a copy of the form he completed - along with his explanation saying I wouldnt return the tax disc). But the people on the phone at the DVLA say "sorry mate, nothing we can do - its the owners responsibilty to tax the car..........put it in writing" !!!!!!!!
I wrote a letter back to the DVLA explaining whats happened, & questioned how this can be legal, otherwise anyone could claim the tax back on a car they had sold on.
They reply saying I should buy a tax disc NOW, even though I still have 2 months remaining on the one that is in my car !!!!!!!!
which I have now done.

What? Thats outrageous! If it was me I wouldn't have purchased a second tax disk when I already have one, no matter how many scary words they put in a letter. Don't let it go, bombard them with letters and demand an explanation and a re-fund. That cannot be legal. Alternatively send them the tax disk but with a tax refund form and see what happens

What a premium-grade anus-ferret. Sounds like the chap requires a robust shoe-ing. Either that or consult the CAB, I'm pretty sure that you could take him to court over it. WAQNA.

Thats an eye opener, thanks for sharing that. The idiocy of the VDLA seems to know no bounds at the minute. don't normally do "bullet points", but this sorry situation seems to warrant it
1) What a tight curse word. 2 months f*cking tax and he just HAS to cash it in. What a tit.
2) Then when he doesnt get his way, after HE overlooked it, he gets all petty and writes a letter to the DVLA, generating you a fine so that he can have £20. What a Knobhead.
2) This is just the latest in a series of shocking incidents where the DVLA seem to contravene their own rules to make someone`s life difficult. Yesterday I lost it and shouted at the top of my voice to one of their "computer says no" drones at their local office, they were trying to claim that a tax disc printed and sold FROM THAT VERY OFFICE did not exist!!!!!!!!!
This morning I received a V5 for an old Astra that I have never heard of!!! What arsebandits! They should all be relocated to one of the hotter parts of the Sun`s surface!

The DVLA seem to just make it all up as they go along don't they. Are we saying that they are expecting two tax discs to be in circulation for this car at once?
Or that folk can cash in tax discs on cars they don't own? If so theres a lot of money to be made right there.

You'd be calling the cops if this twatbucket came round at night and nicked back the alloys of the car he sold you cos he decided he wanted them back. This is no different. Just heard this one;
One of my old cars was stolen and I reported it to the police. When I got the car back again I noticed that the tax-disc had gone. I immediately told the DVLA who told me that I needed a note from the police to confirm that the car had been stolen so I got one pretty quickly and posted it off.
They wrote back saying that the tax had been claimed - after I told them that the car was stolen. I asked them how that could be possible and they just said that they paid out to whoever presented the disk.....I told them they owed me money as they had been told that it was stolen. Gues what - they basically told me that it was tough.
I told the police and they said it shouldn't be possible without proof of ownership or transfer of the vehicle.
So I guess the DVLA just make up their own rules. The guy that stole my car got my tax refund!
So..............You can only claim a refund from the DVLA by giving them a name and address to which to send the refund. But I don't think you need anything other than the disc.
So, when they have these "4x4" discs that cost £400 we know what's going to happen there then...
As far as buying a vehicle with tax is concerned, this is a loophole. It is up to the seller to inform the DVLA that he has sold the car. There is nothing to stop him selling it, then claiming the disc is stolen or damaged, getting a replacement issued, then claiming a refund. All of this before he sends off the form to say that he sold it.

I'm actually a bit worried about this one. Because i have a small incident of them fcuking up here on my hands.
Last week i recieved a log book in my name for a motorcycle i got rid of last october, i swapped it for a camaro. The guy who had the bike got a logbook for it, i know he did as i stayed in touch for a while. I got one for the camaro (which has now been sold and i assume the new owner ha sa logbook for it now) But why has the bike logbook now turned up here in my name? And whats worse it has the date i actually got the bike back in may 2006 on it, so its like the guy who i sot rid of it too never exsisted (and he isnt shown as the previous keeper)
Advice greatly recieved.

stinkwheel - had similar. write back, saying form was sent off with new owners details, no longer in my possesion. have saved the MS Word letter if you want a template. they will liekly try to scare you, but as long as you sent off your bit, its their responisibility, and the words 'legal' and 'feck aff' usually work here to original point of thread... DO NOT LET THEM GET AWAY WITH THIS! i hate, hate, HATE the licencing authorites for being so idiot-filled they cannot see over the end of their own pinocchio noses. take a dated picture of the valid disc. tell them its going legal, and as previously said, inform the police of a documented fraud. although they will liekly do nothing, but they might be bored this week. you must, and with enough strong letter, get your money back, and make the authorites feel it too. without people like us standing up to this, the general motoring public will continue to get letters like my mum did and was likely to pay up if she hadn't had me to fix: a car I owned and sold on was later untaxed, i had a £80 fine, £40odd arrears or else a max £1k fine if i didnt pay up. oh but it was only £40 fine if i paid up sharpish. i told them to pish off and contact the new owner whose details had been posted to them.

Hasnt the previous owner comitted fraud? Best to speak to a solicitor. Once you bought the car the tax was yours, and he shouldnt have been able to cash in the tax without a tax disc.
I tried to cash in the tax on an old astra id bought from a mates dad. They told me that the car wasnt registered to me so I couldnt claim it. A month or so later after they had finally recieved the V5 with my name on it I got the refund in full...... Couple of months later I get a fine for having no tax....... DVLA moves in mysterious ways.
