Right then, Last December I bought a universal centre arm rest from German ebay, it was a Buy It Now auction, 15 or 20 lots listed. The seller contacted me to say that the item 'was out of stock' and would be sent to me in five to six weeks! Not acceptable on my part, surely if you're auctioning something you should actually have it in hand? (first point I stand to be corrected on) So I contact him, say this is unacceptable and order a similar item in a different finish through another one of his BIN auctions, this takes a month arrive and is frankly, of wibblepoo quality. I didn't even bother using it... Putting this down to experience I don't neg his ass to hell and leave it be. Well karma has a funny way of messing with things, he contacts me to demand payment for the first item, I ignore it. Now I've got a demand from this bunch www.mediafinanz.de for 56 Euros... There charges for summat or other. Okay, so the plain facts are... I pressed BUY IT NOW twice, I paid once. Am I screwed or do I have some form of recourse due to his shonky trading methods? Or do I just have to take it on the chin and expect that somewhere in his description there's going to be some hideous small print covering his stinky ass. Can they do anything to me in this country? I'm assuming under EU trade laws they must be able to... But frankly the guy is acting like c&*%!

I think you should just tell him, and them, to f**k right off!!! He’s bang out of order for flogging stuff he doesn’t even have anyway.

Since you haven't recieved the goods and don't even want them I believe your consumer rights allows you to back out of any contract to purchase.

I've been doing that quite a lot in the last hour, in my head, plus a few karate style chops to the chops... And MWF, I thought there must be something I could hit them with. First time I make contact though, I exist, at the moment all they've got is an address that I could have potentially left etc. I really want to get his right first time, I've wasted enough time on it already

He can argue you should have been aware but the fact is you weren't.

What did the add say about the postage, did it say anything about delivery time bieng 5 to 6 weeks? If it doesnt, tell him what he can do, with the same applying to the horse he rode in on.

Nice, what is also complicating this whole process is that he's coming at me in German and I'm having to use Babelfish to translate... Needless to say, my chicken will be cooked by moonlight and I'll post back his mother. I think I'm just going to write him a letter in crayon saying I love him, and pop a few fish fingers in as a little pressie...

How irritating. It was one of those adds with a million boxes below it listing all kinds of curse word which kind of become really relevant at a time like this. I still reckon you shouldn't be able to auction goods you don't own...

Yep, it's against Ebay rules to list an item you don't have in stock. I often wondered about this as I know a guy who does just this. He lists stuff (BIN only I think) and if it sells he buys it in (his supplier does free next day delivery as he orders a lot of stuff). Then he repacks and sends it on to the eBay buyer. The only problem comes if the supplier is out of stock or discontines a line. In which case the only decent thing to do is offer a refund. Another friend sells high end ladies clothing and buys it direct from the manufacturer, but she states on her auctions "all goods made to order, please allow 28 days from payment to delivery" and her buyers all seem happy with that. The bottom line really (whether you have the stuff in your hand at the time of sale or not) has to be that if its out of stock or if you can't meet your customer's requirements you give a ful refund right away. This guy sounds like a cock. I've heard loads of horror stories from people buying off eBay.de (only done it twice myself and had no problems) Good luck

Yeah I bought a fuel pump off ebay.de and it doesnt work. Accordingly, I now think all germans are full-on shyster c0ck-wads, including my english mate ALAN who lives there.

I had been holding back on the sweeping nationialistic generalisations... Because I knew somebody would come up with a better one. Thank you Mr B... ;D I've sent the credit company an email outlining my situation, translated on babelfish... Should keep them busy for a while. Let's see what wibblepoo they try to pull next...
