as some of you may recall, i had an accident in march, which resulted in my w123 wagon being written off.a woman in a 54 reg golf going right at a round about,in the left hand lane cut me up and i hit her.so not my fault.gave all the details to the insurance, including the names and addresses of 2 witnesses, who can corroborate my story, and also agree, not down to me. in july her insurance offered me £350 which i refused.i sent them loads of ads from the auto trader site showing the current cost to buy one of these cars, ranging from £595 to £4000.mine was a sh*tter so when they offered me the 595 figure i accepted. just wait for the cheque now i thought.wrong. got a letter yesterday which reads as follows... WTF, one minute they want to pay me for my car, the next its my fault!!! got a phone call from my insurance, telling me that they are not going to back down,cos its blatantly not my fault and would i be willing to got to court.hell yeah, she was the dumbass so why should i pay. so, sometime soon il be getting a summons. SEE YA IN COURT BIATCH!!! ;D

I heard your neck has been hurting recently as well... This kind of thing really scares me. A friend once had her 306 driven into as she was reversing out of a carparking space. Fair enough, she might not have looked around, but the impact was on the front passender door/wing. There was some questions over his insurance, and he would've legged it if the car park security hadn't asked him to return to give his details. I believe the whole thing still hasn't been fully sorted 18 months on.

Thats fugging ridiculous. What is the point in having an insurance company if the other party can come straight to you if they're not happy about what your insurance say? Call their bluff I say, tell them to f**k off and to speak to you ONLY via your insurance company. I did that when some dozy bint crashed into my Maestro van, and I never got any more smart- letters like that one.

WTF!!!I don`t think you have too much to worry about, you have 2 witnesses and they were wiling to pay initially. And do what Mr B said and don`t take any sh1t from them. Let us know how you get on

Good luck mate, I reckon you'll do fine though, seeing as you've got witnesses. When they said that they would pay initially, did they give you that in writing? If so, then all the more evidence you can take into court to prove that they're just a load of corrupt, money-grabbing b*stards trying to get out of paying for their own client's mistakes. Also go in with a limp. ;D ;D ;D

i was a witness to a muppet on a motorbike going up the inside of some traffic getting to junction where lights on red i was sat at the light bint turns right as normal he barrels into the side of her
i only gave address details but they found out my phone no and the gink on the bike was like - can you tell me what happened.............for the good of him
FERK OFF jerk - cue muchos snotty letter to the ins co of this muppet and to the copper at the scene - copper aparently nearly had him for pervertion of justice
youve accepted the ins cos offer thats the end full stop surely

It's called "calling your bluff",if it is like here they will attempt to do a deal on the court house steps for say 200 quid.getting money from insurance companies is like gettng blood froma stone.They don't want to part with money,it's as simple as that. You must legal representation ,it may cost say 150 quid for a letter from your guy to their company but they will back down ,Because you haven't got legals you are a sitting target. In fact you should consider threatening them with a statement of claim,(sue them ) because your pride and joy,the car you saved all your misrable and lonely life for has been destroyed by the wilful arogance of a woman who obviously shouldn't have been driving because she had just finished an argument with her black lover...and she didn't care who she killed in her road rage. Get the point?.they will try the same thing on you.

This woman insurance company aren't playing ball. Your insurance company should be dealing with all this nonsense, get them to pull their fingers out and sort it out - this woman is wasting everyones time.

Maybe this is why insurance is so expensive, cos of the timmys who manage em! and the dozy people crashing intopeople not realising its their fault! go get em.

If youve got legal cover on your insurance you should just forward all claims to them , that statement is deisgined to curse word you up but makes no real sense
"we write in connection with the above matter and advise that we have been instructed in connection with the recovery of losses resulting from the above accident."
Yea ok that bit is fine
"regrettably, your insurers have failed to settle our clients claim and as a result, we have written to your insurers informing them that we have instructions to issue a county court summons, unless they settle the claim within the next 7 days."
So they are now threating the insurance in a vain hope to get somthing
"this letter is written to warn you that as a matter of law, any summons we issue cannot be against your insurer and must be against you personally."
Techinally this is correct but its got nothing to actually do with you, £1 says it never sees court, i had all this when i hit a woman in a fiesta and i never saw court - i never saw anything after that letter

yeah, got legal cover.anything i get has to be forwarded. to be honest I'm not expecting to see court either. my first thoughts when i read the letter were *sh1t*, then i read it and re-read it.third time i thought *hang on, is this trying to scare me?* so I'm calling their bluff. unless perry mason is their lawyer i cant see how i wont win.but I'm not counting on the british legal system, so I'm not being cocky.

Write them a polite letter outlining your stance on the matter. Don't forget to include the key phrase 'F**K OFF COCKERS! I'LL NAIL YOUR PUNK 4SS GOOD & PROPER' to show them you're serious of course.
