Quick question,.. if the sharp bits above a bonnet are over head height for most people, do they still count? For example if someone had an 8 foot tall exhaust (painted yellow obvious) up out their bonnet with a bend (at the top) so that it goes towards the back of the car. Would that be unMOTable/illegal? Facts please, because its obviously a very silly thing to do.

Definitely fight it, the copper involved obviously needs re-training and isn't up to scratch. Plus I'll wager it was his time of the month, his sanitary towel was giving him embarassing feminine itching and Gregg's had run out of donuts. (tries to resist going into a "haven't these overpaid ar5eholes got anything better to do than harass innocent motorist easy targets when this country's being over-run with illiterate criminal chav scum"-type rant. Fails. Goes into lounge and puts N.W.A's 'F**k Tha Police' on at 120db. Feels better)

even winscreen wipers can cause more damage to a pedestrian as they go over the car than your blower.....AAAAGGGGGGGGHHHHHHHHH
as for impeding your view of the road.... a court was won as the guy showed up with a document allowing the use of the bonnet to carry a spare tyre, (land rover)... as soon as the Judge saw this and its "compliance" with UK law he threw the case out.. he was also shown pictures from inside the car giving a forward view-point.....and the same pic for the Landy.....you couldnt see anything much in front of the Landy

Just a note that on another forum I used to frequent (PassionFord) a guy on there had a run in with an unreasonable cop who claimed his car wasn't road worthy. He complained to the station and it made his car owning life a bit of a nightmare as then all the local police seemed out to get him.

I got pulled a few years back and the plod discovered that my centre exhaust clamp was in a dangerous position and could injure someone (the studs were pointing downwards). I pointed out that by that point they'd be in too much pain to notice anyway after having been belted by the front bumper, crushed by the sump, burned by the exhaust and probably chewed up by the propshaft en route. He just gave me a 'smartarse' look and a 7-day wonder. Pillock.

OK, so we should BAN all plod cars from the road then...
as they may injure us if we happen to hit the reinforced grille, bounce up and into the securely mounted roof light rig, topple over the rear screen to be whipped to death by no less than 3 metal aerial masts........SAFE....I don't think so...

i can understand the impact part but as already stated the front of the car would do alot more damage the blower pulley is covered and the carb is held on with shear bolts so in the event of an impact i'm more likely to get hit by parts of it than who ever is stupid enough to step out in front of it

If anything like that happens go to the Police Complaints Commission. My mate used to get pulled and searched all the time purely because he was black and drove an M3 Convertible. Complained to the PCC and it stopped. Matt

So how are you going to get round this then NR?
I guess you are going to have to proove somehow that the car is indeed safe to drive, or as said above, you'll suddenly become a marked man. What a sod of a situation for something that is obviously safer to drive and better maintained than 95% of all the other cars on the road...

Surely there's a precedent for this kind of thing, as per the Landy example? Loads of cars out there with blowers, and loads with ally bug-catcher scoops. Praps cop #2 felt he'd better do something, rather than be seen to disagree with cop #1.
It's a shame there's the 'odd one' out there. I was repeatedly stopped by the same cop on one of my bikes, had to change my route to avoid him. Not to do with the subject of the thread but I'd still rather have cops than cameras though.

What do you do now then, not drive the estate any more? Or just wait till tomorrow then carry on as normal.

you know how if police equipment isnt calibrated either on the day or within a certain time anything on it isnt admissable
how about you get them to explain why seeing as you aint a criminal he had to get another plod out?
if hes not qualified to do what hes supposed surely the ticket is worthless - and he needs more training?
FIGHT FIGHT FIGHT!!!

Get Dom (and perhaps a couple of others) to file 'engineers reports' stating that the car is perfectly safe then appeal the points and fine with costs for lost time at work et cetera.

result was one wasted lunch break and afternoon work one ticket for driving a car in a dangerous condition on a public road 3 points and a sixty pound fine cheer's for that cad and he followed me home to make sure I didn't use the car anymore got a bit of a shock when I pulled the van out the garage though ;D fool Took ticket, fine and points = screwed Refuse ticket demand summons and day in court = chance to defend your case Never took a ticket for something I wasn't prepared to admit Speeding SP30 85 in 60 = took ticket - got caught pay price don't argue Jumping red light = Refused ticket points and fine - told officers I would see them in court - went to magistrates - lost (expected result) so appealed to CROWN court - won - all points and fine dished out at Magistrates quashed all costs against police for my barister etc etc....... Celebrating in local pub next to police station after CROWN court win when the officers concerned finished the shift - priceless (on the downside I don't go back to that town if I can avoid it as I made 2 constables, a sergeant, an inspector and a chief inspector look like fools - but then if 2 officers commit purjury in magistrates court I'm hardly going to ignore it am I - I din't need to prove it either both told a different story therefore one or other was lying.) Never accept a fixed penalty ticket, point and fine if you intend to contest the issue Only way forward now is to not pay fine and get summons to appear in court and you are then on a losing streak as they will summons you for non payment and the original offence

Was the officer a qualified vehicle examiner ? A lot of them aren`t these days. Did he take any photographs of the (alledged) offending articles to back up any further case. I would get the vehicle examined with an independant report and fight the ticket.(Should I be even suggesting this ?)

Your unlikely to run anybody over anyway, the noise would make sure that any pedestrians will see you in plenty of time! Bad luck with the police. I have to say ive heard many similar stories but my experience with traffic cops have always been ok. they're not all like the one you met! Never a good idea to get shirty with the cops though, even if they do have an attitude. Just don't give them the excuse they need to stitch you up! Anyway... If you are unhappy with the ticket don't pay it, get an engineers report saying the car is 100% safe, wait for the court summons and go to court. Theres an excellet chance it wont get as far as court seeing as its such a borderline case, (once copper says its ok, the other one doesnt) You may get a letter saying the case has been dropped or they may just dissapear altogether. If it does go to court it will only be a magistrates which is nothing to worry about. Again, when you get to court you may find the CROWN prosecution service have dropped the case because of lack of evidence (i.e its b0llocks) Take plenty of pics, the engineers report and win the mags over, common sense will prevail, the case will be thrown out and youll beable to claim costs from the police. WINNAR. Even if you somehow lose, it will probably just be the 3 points, £60 fine plus £30 costs. Might be more though. Id get over to www.pepipoo.com. Its an excellent site and the members on the forum have had plenty of dealings with the police and know the legal system well. Its mostly speeding cases but they cover everything. Well worth asking about. Good luck!
