First of all F**K!!
When the Rover Streetwise packed in at the end of June I borrowed my work mates Clio, whilst I had it I got a speeding ticket, curse word but fine my fault! Sent off details etc Now my mate receives a letter wanting to see his insurance to see if I'm covered. I assumed as I had fully Comprehensive cover that I was covered 3rd party on any vehicle. Just checked and I don't do now I'm absolutely bricking it.
I already have 3 point from 2 years a go in November.
It was a genuine mistake, I'm not one for flouting laws and would not have used the vehicle knowing I was uninsured.
Any thoughts???

It's common practice now for insurers to surreptitiously remove the 3rd party clause from policies. Who's the letter from that your mate has received?

Ouch! Sorry to hear that If your policy doesn't cover you for driving other vehicles and you aren't a named driver on your mate's policy, I don't see anything that you can do. Probably not worth risking a court appearance either as they can increase the fine and maybe even issue a ban. Plus they are quite clear that "ignorance is no defence". Looks like you're going to have to be VERY careful for the next 4 years

Oh plop, just re-read it and realised the the 6 point for no insurance will give you a ban!! Poop! Isn't 12 points a ban? As I read it he'd end up with 9 points if it is 6 points for no insurance. Oh wait it would be 12 with the speeding. I don't know if that is an automatic ban, I've seen people with 12 (in fact more than 12) that aren't banned from driving.

Exactly what I did HoTWire! I wonder though if it might be worth the risk of going to court after all, Slacker? You can't argue that you're not guilty, but is there some argument you could make about not getting a ban? Perhaps not being able to work if you lost your license? According to this the criteria is a little more complex. In terms of checking, the only thing I can think of is this, which tells you the date of offence.

I'd probably find a half decent solicitor who deals with that kind of thing. If your livelihood is at stake they will usually wave a ban I think but id get somone who knows what they are doing to help you rather than us amateurs.

Don't mess around with local solicitors who may very well not have the requisite skillset. Google "direct access barrister motoring offences disqualification" or something similar. It's not that cut and dried, depends in which Police County the previous points were earned. There's a modicum of flexibility from force to force (mainly around the speed windows), but the national guidelines are that if you've been convicted or attended a course in the last three years you won't get offered one. Yorks police are usually pretty draconian with speeders due to the amount of bikers that die on their patch.

Definitely worth speaking to a solicitor .
A long time ago i got in trouble & was looking at a ban & hefty fine .
A good solicitor explained I needed my license for my job .
A letter from my boss confirmed this .
I ended up keeping my license , but had a massive fine that i needed a payment plan for .
Get yourself proper advice , things change & what happened to someone 6 months ago could result in a different outcome today .

What were the 3 points 2 years ago for? If speeding then you won't get police naughty school. The other thing is that if you're not covered on your mates policy he may get done as well as you.
