I have been off on annual leave and have two young kids to entertain and took them for a bike ride hoping to find the next project tucked away in the back streets, I was shocked to came across a abandoned kit car, its a yellow 308GTS replica based on a 1979 Fiat X19, it looks like its been there for a few years and I was surprised that I didn't come across it before. The 1.3 beast is SORN'd and was last MOT'D in 2013, I assume that SORN has to be done every year and is being done so by someone right?. Today I tried to trace the owner, its parked on a private car space and I was told by a resident the owner was elderly gent who died in 2014 and after his death his wife emigrated to Australia and the flat sold. The new owner of the property is renting it out. The residents are bothered as its been taking up a parking space for a number of years and because people are knocking random doors of the block asking about it . I will try to obtain the landlords details and also try to contact the wife or the legal owner and try to rescue it, I'm not to fussed if it doesn't pan out but its worth a shot. If no legal owner can be traced I believe the landlady's parking space has right over it above anyone else. If the landlady is not bothered I will do a V888 and hope I have a reasonable cause to obtain details. Has anyone had any success with this sort of situation or applied for details of a abandon car via V888 and got a result from DVLA?

get a letter from the land lady stating the facts , apply to dvla for v5 , make a donation to a charity , Can it be so simple, hope she's doesn't believe its real or sick of people bothering her, I assume requesting a V5 they will contact the last registered owner before they send one out a new one and I have to make reasonable attempts to track the legal owner like V888 via DVLA letter from the landlady, I might be lucky to get a V5 but someone might swoop in and say it belongs to them, if so fair enough.

It used to be the case that SORN had to be declared every year. This was changed some time back so that once SORN is applied for it's valid until the vehicle is taxed again.

I can't offer any advice being Australian, but that has got to be the coolest Ferrari replica I've ever seen! Love it, everything looks "right" just cartoonified. I'm a huge fan - good luck with the process!

This happened with a car stored in a lockup in east london. Letting agent applied for V5 and DVLA contacted last owner (who owed a large amount of back rent) As no response was received by DVLA they issued a new V5 in the letting agents name and he took responsibility for it, moving it to his home address. Sadly the DVLA's system is seriously flawed in that you may have the car, V5 etc but that still does not make you the legal owner of the vehicle, just the 'recorded keeper'. If you apply for the V5 and get it, ask the property owner to sign a receipt making you the legal owner? Its a nice kit, good luck with the rescue.

i done the same thing a few years back , yes do it by the book , the land lady can give a letter to show the last owner died , wife left , died etc , car is now in the way , all legal . with the evidence and apply for v5 , totally legal , then sorn car in your name , if not council can make an order to lift the car , then make a donation to a good CHARITY , one for children would be good , local childrens hospice . don t let ir=t get destroyed , owen . i done mine straight forward

I'm pretty sure the landlord can claim ownership on the basis of it being abandoned on her land with no payment for storage fees for 'x' amount years which would have susperseded the value of the car?

Thanks for all the responses, my understanding is that the gent lived with his wife who I need to get hold of and if not speak to the landlady about obtaining it off her land. I think once this and V888 application and a new V5 I have tried all resnoble attempts to track the owner and I would only be the registered keeper, if a person comes forward and claims it I acted in good faith and haven't acted dishonestly to appropriate property belonging to another therefore no theft.
Is worth a shot

It's the wheels that tell me its done to a good standard and that the engine has lots of shinny bits and it might have had a engine transplant

what an unusual but interesting machine! not sure about the legal ownership issue...but I doubt it would bite you too hard in the derriere if you follow most of the advice above. once you have exhausted all reasonable avenues fall back on good fortune. as a total butt covering exercise I would keep accounts on all expenditure though....just in case. good luck.

It will have passed to his wife unless it went elsewhere in any will he might have left. How on earth does paying money to a charity make you the proper owner of the car?

No, you've not touched a nerve at all. Not sure where the land owner comes into it or why you'd want to make any sort of gesture in their direction.
From the OP's post - the owner died - ownership transfers to his widow (unless he specified differently in any will). It matters not where she is - it's still her car. I'm pretty sure 'finders keepers' doesn't have any basis in law.
