Devils advocate ...
Legally its the responsibility of the driver to check all the lashings. It does not matter who loaded it,if someone different drives it,they are the ones held responsible in law.
Devils advocate
Just thought i'd mention that,as parties may use thats for and against in the ensuing arguements.

Well the gloves are off.
"At this stage it is not possible to accept any liability in the matter as I am not in receipt of all of the facts. Without seeing the report of the garage I cannot confirm what the time frame for repairs will be or the extent of them. Unfortunately, it would not be possible for us to arrange for a replacement van at this stage and I understand you have previously confirmed the use of an alternative. As a gesture of goodwill at this stage, without any admission of liability, I am willing to reimburse the cost of 3 days van hire or a maximum of £60.00 per day to the total of £180.00 subject to receipts being provided."
wrong answer. Spoke to a journo and this will be front page next week

I worked for a recovery company for a while, any cock ups like that are down to the driver through incorrect loading/unloading, incorrect weight placement etc
I can not see how any of this was your fault as you do t load or unload the motor

If so what are you hopping to gain? yes, you are missing quite a lot. The RAC damaged our luton whilst trying to recover her. How she didn't flip off the truck and land on her side on the pavement I will never know. Current know damage is bent N/S springs, a ripped crossmember, squashed spring hanger and displaced rear axle. Been off the road 4 days, and easily the next week, if we can get the parts together.

Obv it was either the driver, truck or both. Never mind who is paying him, I called the RAC. Its the RACs responsibility EXACTLY!!! That's who you had your "contract" with. The fact that they may use an agent to act on their behalf is neither here nor there. You will win.

Thanks Zeb. Whats irritating me is how the RAC are dragging thier feet. How they think they can deny liability at all is beyond me.

just a little side note to all this as many of us on this forum have modified our cars a little.a couple of years ago my wifes morris minor blew a top hose and needed recovering, the rac man turned up to take a look then proceeded to tell me it wouldn't be possible to transport the car as it was modified and the rac are 'not obliged to recover modified vehicles'.i told him I thought it was only cars that had been used in motorsport or speedtesting that were not covered(I once had my v8 pop recovered from shakespeare county raceway after, ahem,'watching' the drag racing and we pushed it outside the gate and wiped off the race numbers!)anyway he was having none of it and it was only when I threatened to cancel my rac subs that he got it taken.i cancelled anyway as I thought I don't want to go through all that again.btw fredtransit this is not implying anything against you,i just thought this was a good place to inform people they may not have the peace of mind cover they thought they had with the rac.

In fairness the AA aren't much better in my experience. When my Sierra Cosworth blew a coolant hose, the 'patrol' that turned up first of all tried to recover me however bearing in mind I'd spent 4 years restoring it and it doesn't have a mark on it. He said and I quote "I CAN'T GUARANTEE I WON'T DAMAGE YOUR TOWING EYE OR FRONT BUMPER"
When I politely declined and asked for a flatbed lift. He called his control and I overheard him stating I was awkward and a difficult customer.
I complained but in the end I got told it was one word against another and nothing was done. I can't even cancel my membership as it comes with my bank account.
I learnt along time ago that nobody looks after your car/van the way you would so don't trust anyone with it.
I really hope you get your Transit Luton sorted out as she looks fantastic and I do love a classic commercial.

Try Britannia Rescue. Never had any problems with recovering the rally car, even after the occasional attempt to rearrange the local scenery.
I know I've told this story before, but what really enamored them to me was when my wife broke down on a country road, with the children in the car. She called BR and they put everything in train, however about 5 mins after she'd called a police car pulled up; apparently BR had called them to let them know there was a lone female with children in the area. Top notch, proper customer service!
