Well simply I recieved a speeding ticket, I was pulled over by a traffic car, then given a ticket (fixed penalty, £60 3pts). This was fine until I had noticed the police officer had writen the wrong date on the ticket, this was after handing in my lisence, I went back to the station and reclaimed it. This means that I now have to go to court now.
Where do I stand on this issue, as I'm a little confused??
I'm not prepared to acept I was there 24hours earlier, but are they going to give me a new ticket(with correct date), or just drop it, or maybe call me a lier and say that he got the date right??

As far as where you stand its probably a case of you will say yes, he got the date wrong, he will say yes he got the date wrong. If you are lucky they will say well there was an error no charge or if not then you will get the 60 quid and 3 points. Nothing worse i shouldnt imagine.
One thing though, you handed in your licence? I thought fixed penalty were just sent off by post?

I don't want to get your hopes up but chances are it might get dropped as he has filled out the wrong date.Police paper work has to be spot on for any conviction to stick.Fight them at it and you may get off.Best of luck mate

One thing though, you handed in your licence? I thought fixed penalty were just sent off by post? Erm i not sure, i was just told to take my licence to the closest police station, along with my mot plus insurance? Guy

You should get away with it as has been said the paperwork must be entirely correct at the time the offence was made. You can even get away if they spell your name wrong.

Sounds like a producer, which means you have to go and show them your documents but they usually just tick the boxes that say you have all relevant legal paperwork and then hand them back to you?
unless things have changed since i got done last.

if i was you id have a word with the duty solicitor on the day (unless you go & see one that does the advice hour free thing ) as you are right that on the date you got the ticket you where not there (get proof if possible ) but they might just issue another one as its a small technical mistake BUT its still wrong so get advice but be warned if you do make a song & dance about it your next mistake will cost you as you will be marked & ive just noticed where you are from & the cheif constable there LOVES the motorist so have fun ;D

Wrong date means the ticket is inadmissible as evidence and would be thrown out of court. Thats the law.

Not sure if the date falls into this category or not though. If you were pulled at the side of the road and surrendered your licence there and then the chances of getting away with it are much less than if you were flashed by a gatso or similar. Golden rule of being pulled by the police- NEVER surrender your licence there and then as they take it as an admission of guilt. They don't have the power to take your licence at the side of the road. Insist you keep hold of it! Did you accept that you were speeding to the officer? If you admit you were speeding to the officer then thats all their hard work done for them- they don't have the proove the speed as you have admitted guilt. don't know how you managed to get your licence back off them after surrendering it though. Now the date thing........ Assuming its not covered by the rule of slip, don't tell the police their error as they can amend tickets if given enough time. Can you prove that on the date on the ticket you were not in that area at the time? Takes a bit of bottle this way but don't pay the ticket, eventually you will be summonsed to court, there is a small chance the ticket will vanish into thin air though. In court when they ask you if you are guilty or not guilty of travelling in excess of Xmph on X date on X road, tell them not guilty and when they ask why say theres no case to answer as on that date you were at home with the missus/at work in an office/ scuba diving in hawaii or whatever you were doing (don't lie) The case will be thrown out, the Magistrates will bollock the CPS for fouling up and wasting everyones time AGAIN and you ca claim for costs. Happy days. If you don't hear anything within 6 months and 22 days they have forgotten about it and its too late for them to do you. 6 months from the date of the offence to lay the papers in court, 22 days for the message to get to you that you have to go to court. get a good solicitor,sit back and laugh.my friend got away with doing90mph through a 30zone on a bike because the oficer had writen the wrong bike down.eg it was a cbr 600 and he put down a gxr1000, registration was correct but the bike details wernt. good luck

I'm going to speak to a police officer tomorrow about this subject, I will let you all about any info I find out. Thanks again Guy don't tell the police that the dates wrong though, they change it to the correct date and send out a new ticket.
