Long story short. I bought a 4x4 on 22/2/13 of a local. He had it MOT'd locally 5/11/12. I bought it in a rush as I needed a working car asap. I'm ashamed I didn't spot the rusted-right-through cross member, the hole between the body mount and seatbelt mount that my hand fits through and the rest.. The clonking I thought was a leaf spring bush is the body and chassis meeting! So I've been a prize plum and bought another peice of curse word. The seller advertised it a week after the 3 month VOSA deadline for corrosion related appeals was up. I visited the tester who, speaking about the former owner, said "curse word! I didn't know he was gonna sell it" So I'm convinced it was a dodgy deal from the beginning. The garage owner has said "tough" The former owner has become a bit elusive. I know he knew it was in no state to be on the road. Why would the tester care whether it was being sold or not if the test was kosher? So.. I know the VOSA's deadline of three months is well and truly behind us. But is there an exception made in extreme cases? I don't seem to be able to get anything but a robot response on the phone from VOSA. Attachments:

I'm pretty sure 3 months is the absolute cut off point, its 5 months down the line now and things could have got a lot worse in that time especially on a 4x4 which might get used dragging boats in and out of the water etc. I'm not saying that that was ever ok at mot time but VOSA have to draw the line somewhere... Like you say no reason at all for the MOT man to care if it was being sold on or not.... What vehicle is it? Is it worth while welding it up?

Yeah the line has to be drawn. I thought I'd be screwed to be honest.
It's a 1989 Daihatsu Sportrak. I like the little truck but no it wouldn't be worth paying to have it welded. I've never welded bodywork successfuly, maybe this is my chance to learn.. The seams between the rear arches and floor both sides and the rear and central chassis crossmembersa need pretty much replacing.

I have just broken up a Sportrak and the rot was incredible. The chassis was ok actually, but the body was completely shot, and I mean rotten well beyond being fixable, especially around the rear arches where the roll bar mounts, boot floor and rear body mounts.

Depending on where the seat belt mounts are the rear arches and floor may not come into the MOT as its on a chassis. Diahatsu's seem to have a habit of rotting when you least expect it!

Mot`s aint worth the paper they`re printed on. When i bought my estate it had 10months mot but had failed first time and had a load of advisorys. The day after it passed with no advisorys but NONE of the work had being done. Id checked the car out before i bought it so knew the problems but it shouldnt have been on the road,it even had springs cut in half and cable tied back together with the two halves inside each other for added `lowz`.

Sounds like you've been completely stitched up . i would get a 2nd hand welder , watch some youtube videos and look on migwelding.com and have a crack at fixing it . Nothing to loose is there and at least you can learn to weld - one positive to come out of it . Get dug in with a screwdriver!!

I do feel pretty stiched up. I'm going to lean on the seller as I know he knew that it was unroadworthy. I'm going to push for money out of him "to repair it" but be prepared to give it back for a refund. So if I do end up being left with it then I guess I'll be looking for a mig..
There was one advisory, "Slight corrosion on rear crossmember" It's rotten from one end to the other and one end is broken completely through, the only thing it's attached to is the body. That's the first photo.
I'm going to report the tester to. I know VOSA do send cars with known faults to some stations as a test of their standards. But after the visits I've made to the testing garage I can't imagine them taking any chances.
Talking of rot I bought a 1990 Discovery yesterday to replace the Sportrak. I spent a good while under it with a torch and pokey before paying though!
