1. Ring the insurance company and play merry bloody hell with them. If they've sent an auto renewal note and said you don't have to do anything, then not renewed, that's an error on their part that they can easily sort out. You should have been insured and it isn't your fault that you weren't.
2. Tell Skoda-man to go and get curse word. You've been more than fair in offering to fix the damage and he is trying to take advantage. If what you've offered isn't good enough, he can go through his insurance and have the car written off. Which he presumably won't want to do.

Mate for god sake, don't pay him a penny - Go to police & report him for blackmail. TELL THE WHOLE TRUTH. At worse, your brother gets a slap on the wrist and a £80 fine. It's your word against his and even though you have tried everything to get him to go to a garage, he could just deny it, same as you could. HE's GOT NOTHING on you. If you were a bit dodgy, YOU could even deny hitting him (Provided he has no witness) You could go further & say he reversed into YOU.
If it were me, I'd tell him to take a hike & do his worst. IF on the other hand, you don't want to be so harsh, offer him what you are happy with, say £300 or whatever BUT get him to sign that it is "In full & final settlement for damaged to car" and have it witnessed - IF he says no to that, he's a mug!

I'm afraid you or your brother were driving uninsured. Insurance is strict liability. You either were insured or you weren't. There is no inbetween.
That having been said, the chances of a prosecution in the circumstances you've outlined are very slim and the penalties - if it was an error by your insurers - minimal.

Just got in fro sorting this issue out, spoken to there a couple of legal people and the final solution agreed is We will pay for the repairs on the car to a maximum value of £700, the value of the car . He signs upon completion that all the damage incurred has been properly repaired. Any further action he takes will end with him facing blackmail charges. An amicable solution for both involved
Thanks for all the insight and opinions, really has been most helpful and has probably saved my brother a lot of money and any potential future problems with this guy! Thanks
